Employee sustains multiple fractures when struck by beam

At approximately 10:45 a.m. on March 31, 1995, Employee #1 had tack welded two small metal plates on both sides of two 7 ft high columns. A beam was then rested on top of the columns. A second beam was being lifted into position by a Bobcat for Employee #1 to weld. As he picked up a ladder that was near the unsecured beam, the second beam bumped the first beam, knocking it out of its cradle. The beam fell, striking the ladder and Employee #1's hard hat. Employee #1 was transported to Mercy Hospital, where he was treated for four fractured vertebrae and a fractured pelvis. According to the employer, Employee #1 was trained and had many years of experience; however, he ignored the employer's instruction not to work under a crane, forklift, etc. During the investigation, no malfunction in equipment or accident-related violation was found. One general violation was found and a citation was issued with a penalty.
