Running skilsaw falls striking employee's foot and cuts toe

On February 20, 2004, an employee was working as a framing contractor. He was cutting 2 by 4 pieces of wood with a skill saw to frame up a wall for the building. He positioned the wood on his knee and began cutting the wood. The saw blade got in a bind and kicked back. He let the saw drop and it fell on his right foot. The saw blade cut into the top of his shoe and then cut his big toe. He was hospitalized for five days with a deep laceration to his right big toe.
