Employee injured when struck by falling gate

At approximately 3:00 p.m. on March 6, 1994, Employee #1 was attempting to close a gate to secure a storage area of this building material sales company. There are two gates that are used to close the street opening into this storage area. One of the gates is approximately 40 feet in length by 7 feet in height. The smaller of the two gates is approximately 12 feet in length and 7 feet in height. Employees that are required to close the gates have been instructed to close the smaller of three gates first in order to give the end of the larger gate more stability when it is closed. There is also a sign posted on the gates instructing employees to close the small gate before closing the large gate. Employee #1 has closed the gates, as instructed, numerous times in the past. Apparently Employee #1 closed the large gate before closing the small gate, turned to close the small gate, and the large gate fell on him, knocking him to the asphalt. He suffered injuries to his head and swelling of his brain.
