Employee fractures elbow in fall from stepladder

At approximately 12:00 p.m. on August 16, 1995, Employee #1, business manager of Diesel Dan's Truck Repair, was helping the owner remove bolts from inside the wall of a bobtail truck trailer. He was working from the second step of a Werner 6 ft aluminum stepladder. The owner was outside the trailer holding the bolts. Employee #1 was using an air gun to remove the nuts from the bolts. When he stepped on the third step, the ladder tipped over and he fell backward, landing on his left elbow. He sustained a serious fracture of his left elbow. Employee #1 stated that he had set up the ladder inside the trailer properly and that this was a freak accident. The ladder was only five to six months old and was equipped with rubber footing. No violation of T8CCR was noted.
