Employee's fingertip amputated in punch press

At approximately 2:45 p.m. on February 8, 1996, Employee #1 reached behind the guard of a Niagara 55-ton punch press to remove a jammed part. The punch press, which was unguarded behind the bolster plate, cycled when Employee #1 inadvertently struck the treadle with his right foot. The tip of his left index finger was amputated. The employer was cited for a serious violation of T8CCR 4207(a)(1), because the existing guard system did not prevent Employee #1 from reaching through, over, under, or around the guard. At the time of the accident, Employee #1 was an employee of Western Industrial Management, Inc., who had been leased to and was working for K & L Enterprises.
