Investigation Summary
At approximately 11:00 a.m. on November 21, 1994, Employee #1, of Kirkpatrick Landscaping Services, Inc., was removing oleander bushes from an area next to a fence. He was the supervisor of a crew that had been assigned to dig around the roots of the bushes, remove the plants, and haul them to the other side of the fence for disposal. A coworker had gone up in the basket of an aerial device that was normally used to trim trees to use the boom to pull out a bush. Lanyards were hooked together and attached to the boom and to the bush. Employee #1, deciding that he would go up in the basket and do the work himself, called the coworker to come down. He got into the basket, went back up above the bush, and started to pull it from the ground using the boom of the aerial device. One of the lanyards broke, causing the boom to react because of the strain that had been placed on it. Employee #1 was ejected from the basket and thrown over the fence, falling approximately 25 ft. He received serious head injuries and was hospitalized.
