Employee injures neck when pinned against trailer wall

On April 14, 1994, Employee #1, of White Brothers, a supplier and refurbisher of motorcycle parts and accessories, was inside a 40 ft trailer truck helping to unload metal racks to be installed in a warehouse. Employees, including Employee #1, had successfully unloaded a trailer filled with racks the day before and were almost finished removing the racks from the trailer. Employee #1 was removing the last set of racks from the back of the trailer when the remaining racks collapsed, pinning him against the trailer wall. Employee #1 suffered a stretched neck nerve. This was the only time that the White Brothers had received racks. The cause of the accident was the fact that the load had not been secured for shipment by the shipping company.
