Employee's leg fractured when board kicks back from saw

Employee #1 was standing about 20 ft behind a horizontal DeWalt Radial pull saw being operated by an employee of another employer. A board kicked back out of the saw, striking Employee #1 on the thigh and fracturing his femur just above the knee. No accident-related violations of T8CCR were found involving CH & A and no citation was issued for this accident. A citation was issued for IIPP.
