Feeder dies of fractured neck from possible falling bale

At approximately 5:00 a.m. on December 22, 1994, Employee #1, a 29-year-old feeder, started work feeding calves, heifers, and dry cows. At 5:45 a.m. the owner found him with a fractured neck. The owner and the coroner's deputy theorized that Employee #1 may have been struck by a falling bale, or may have fallen from the top of a 20 ft high stack of baled hay, or may have fallen while attempting to climb the stack. One bale was found on the ground near the body and one bale was missing from the top tier. The coroner found no ladder, hay hooks, or other plausible means for climbing the 20 ft high stack. Employee #1 had worked at this location for nine months, and had previously been employed by another dairy owned by the same employer. The employer had no operative written safety program outlining safe procedures and giving instructions for accessing baled hay stacks and knocking down bales. No accident related violation could be established, given the uncertainty of the source of the fatal injury. However, a serious violation was issued for failure to have written safe procedures for stack access and knocking bales.
