Investigation Summary
At approximately 7:30 a.m. on February 18, 2004, Employee #1, a delivery driver for a beverage company, was making a delivery to a store. The store had a loading dock and he planned to use the store's loading dock plates to help transport the shipment from the truck to the loading dock. The plate consisted of two segments with the first half lowered before a delivery truck backs up to it and the second half fits over the truck floor. The delivery truck was equipped with a lift gate, which he lowered below the loading dock elevation upon arrival. Then he opened the rear truck door by hand. There was a metal bar available to help open the rear truck door, but he did not use it. The store's loading dock plate, Model Number 70806, Serial Number EOD7230D, manufactured by Rite and Hite Corporation, was lowered and Employee #1 backed up the truck against the loading dock. The two segment dock plate was placed over the truck floor and he completed the delivery. As Employee #1 prepared to leave, he used his left hand to pull the dock plates away from the truck floor and proceeded to bring up the truck's lift gate. The lift gate came into contact with the edge of the dock plate, providing resistance. He forced the dock plate back with his left hand to clear the lift gate and continue movement. The lift gate began to bulge, causing displacement outward as it was raised, and Employee #1's hand became pinched between the stationary dock plate and the moving lift gate. He was hospitalized at Citrus Valley Medical Center; Foothill Presbyterian Hospital, where he was treated for a partial amputation of his left index and middle fingers. There was no bone loss associated with the injury.
