Employee is run over by the front wheel of a tractor

Four employees were returning from a pistachio orchard for lunch. Employee #1 was the authorized driver of a John Deere 245 tractor which had a front end attachment with a brush rake on it. The brush rake looks like the forks on a forklift but has six blades on it. The employees decided that an employee other than Employee #1 would drive. The remaining three, including Employee #1, got on the brush blades. The driver was inexperienced and unauthorized and made a jerky start. Employee #1 fell and was run over by the front wheel of the tractor. Employee #1 suffered a fractured pelvis and a gash on the head. After the accident the immigration service made a sweep and removed 12 employees, including all those involved in the accident except for Employee #1. All the employees involved were employed by Strain Orchards at the time of the accident. The employer was cited for a general violation of 3341(a)(2).
