Carpenter's fingertip amputated when saw kicks back

Employee #1, a carpenter, was doing a remodeling job. While he was cutting a small piece of 2 ft by 4 ft lumber, the saw backed out (kicked back out) of the wood and the middle finger of the hand that was holding the lumber was cut off. The saw blade guard was in place and functioning properly. No violation was found in connection with the accident.
