Employee injured when run over by fork lift

On March 4, 2002, the employee driving the fork lift had just passed Employee #1, turned in to pick up a pallet, and started to pull out. He turned to look over his left shoulder toward the rear of the forklift. He looked over his left shoulder, knowing the right side was clear because he had just driven in from there. Employee #1 stepped up after retrieving a part and the driver began backing up. Employee #1 stepped into the path of the right rear wheel and got his foot crushed under it. When he first yelled, the driver started to get off the fork lift to see what the matter was and Employee #1 told him you are on my foot. The driver jumped back in the seat and pulled forward. Employee #1 received multiple fractures to his foot requiring surgery and was hospitalized.
