Employee struck by falling storage crate

At approximately 7:30 a.m. on June 13, 1995, Employee #1 was loading his moving truck with packing material for a moving job. The warehouse manager was unloading storage crates filled with household goods from another moving truck. The crates measured 85 1/4 in. long by 45 1/4 in. wide by 87 in. high. The warehouse manager was operating a Hyster 5,000 lb forklift, model #S50XL, serial #A187V040116, with blades that were fully extended to 65 1/2 in. long and 39 1/4 in. wide. The warehouse manager had already unloaded 8 of the 9 crates in the order, and was placing crate #10 on crate #9 when the crate started to tip to the left toward where Employee #1 was working. The crate fell off of the forks and pinned Employee #1 against his moving truck. Employee #1 was hospitalized with broken teeth, fluid on his lungs, and broken ribs.
