EMPLOYEE PARTIALLY AMPUTATES FINGERTIPS ON TABLE SAW BLADE

EMPLOYEE #1, AN EMPLOYEE OF WALT DISNEY IMAGINEERING IN NORTH HOLLYWOOD, CALIFORNIA, WAS USING A TABLE SAW TO REMOVE THE FOUR CORNERS OF AN 11-INCH BY 2-INCH BY 2-INCH PIECE OF CLEAR PINE TO PREPARE THE PART FOR TURNING ON A LATHE. THE SAW BLADE WAS SET AT A 45 DEGREE ANGLE AND RAISED TO A 2 INCH HEIGHT. EMPLOYEE #1 WAS PUSHING THE PIECE THROUGH THE SAW WITH A PUSHSTICK HELD IN HIS RIGHT HAND. THE SAW GUARD WAS RAISED APPROXIMATELY 4 INCHES SO THE EMPLOYEE COULD SEE THE CUT BEING MADE. A CLASS B OPERATION GUARD WAS NOT REQUIRED. WHILE EMPLOYEE #1 WAS FINISHING THE LAST CUT, THE REAR OF THE PIECE BEGAN TO KICK UP. EMPLOYEE #1 WAS CONCERNED ABOUT GETTING STRUCK BY THE PIECE AND SO HE REACHED UNDER THE GUARD WITH HIS LEFT HAND TO HOLD IT DOWN WHILE STILL PUSHING THE PIECE THROUGH THE BLADE. HE MISJUDGED THE DISTANCE BETWEEN HIS HAND AND THE BLADE AND STRUCK THE BLADE WITH HIS LEFT MIDDLE AND INDEX FINGERS, CAUSING PARTIAL AMPUTATION OF THOSE TWO FINGERTIPS.
