Employee's ankle broken in fall from ladder

At approximately 8:33 a.m. on February 26, 1992, Employee #1 was spending the day helping a house owner paint the wood trim on the garage of a custom made home. He was standing on a 10 ft ladder to reach the trim, which was 8 ft high. When he tried to descend quickly, the ladder moved sideways. Employee #1 missed the last two steps, which were about 2 ft high. He fell to the rain-soaked ground and twisted his right ankle. Employee #1 sustained a broken ankle and was hospitalized. No defects were found on the ladder. Employee #1 was not following the employer's safety rules. There were no witnesses to the accident and Employee #1 refused to be interviewed. His supervisor provided some of the above information.
