Employee bruised when struck by backhoe bucket

At about 1:30 p.m. on August 3, 1992, Employee #1 was clearing loose soil from an area that was being dug by a backhoe operated by an employee of an independent sub-contractor. When Employee #1 moved quickly to remove some soil that had been scraped, he went behind the backhoe's bucket and out of the backhoe operator's sight. The operator swung the bucket and struck Employee #1, knocking him to the ground. He was taken to Peninsula Hospital for medical examination and was released the same day suffering only bruises.
