Employee struck and killed by falling tree

Employee #1 was limbing and topping a fallen tree while the owner/operator of a Franklin flat shear was felling an approximately 100 ft sheared pine about 75 feet away. That tree was expected to fall approximately 50 ft north of Employee #1 but the wind caught it and pushed it into a fall path directly toward Employee #1. When the tree struck between him and a skidder, the shear caused the top of the pine to whip downward, striking Employee #1 on the head and killing him.
