Employee killed when struck by falling tree

Employee #1, a sled builder who piled debris for the chipper, was cleaning up debris left from a storm. He was standing approximately 18 feet northeast of a broken 6 inch tree that was to be felled. The top portion of the tree had broken off during a storm, and approximately 33 feet of the tree remained to be cut. Employee #1 acknowledged a warning from the cutter that the tree was coming down and began to walk diagonally across the falling tree's path with his back to it. Other employees called out to warn him, but their calls went unheeded. The top 6 inches of the tree struck Employee #1 on the left top side of his head and crushed his skull. He died.
