Employee killed when struck by falling tree

An independent logger asked Employee #1, owner of Chris Arnold Timber Company, to watch the tree that he was going to fell and to alert him if anything unusual happened. As the independent logger was cutting the tree with a chain saw, Employee #1 began cutting a tree which was 39 ft from the base of the tree the independent logger was cutting. He said he did not know Employee #1 was in the fall path of the tree he was cutting. The tree being cut by the independent logger measured 46 ft 8 in. long and 14 in. diameter. The top of the tree had been damaged by a tornado, as had the entire 600 acre tract being cut. Employee #1 was struck in the head and killed by the falling tree. He was wearing a hard hat; however, the hard hat showed no signs of damage.
