Investigation Summary
A forklift operator, who had been working at his company for 3 months, was driving a Toyota forklift. The employee had experience from a previous employer with a Barko Knuckle boom and a grinder. The employee was not wearing the seat belt that was standard equipment in the forklift. In addition, the employer had not established a speed limit for the operation of industrial trucks, and there were no work rules requiring operators to wear seat belts. According to the plant manager, the employee had been trained. The employee had been operating the Toyota forklift as part of his duties for only the previous 2 weeks. As the employee turned the forklift, it overturned. The employee was ejected from the vehicle and pinned between the overhead cage and the ground. The cage landed on the employee's chest. He died of injuries sustained in the accident. An analysis of the worksite and photos taken by the local police department showed that the employee was operating the forklift with the forks about 1.5 meters above the ground. The tire tracks indicated that the turning radius would not provide for stability of the vehicle with the forks in a raised position.
