EMPLOYEES INJURED IN FALL FROM ROOF WHEN CORNICE BREAKS

EMPLOYEES #1 AND #2 WERE WORKING ON THE ROOF OF A THREE-STORY RESIDENTIAL BUILDING THAT HAD BEEN SUBJECTED TO A FIRE AND WAS UNDERGOING RENOVATION AND REHABILITATION. BOTH MEN WERE PUTTING A WEATHERPROOF COVER OVER THE CORNICE (A DECORATIVE COPPER SHEET THAT LOOKS LIKE A PARAPET ON THE EDGE OF THE BUILDING). EMPLOYEES #1 AND #2 WERE TO CONSTRUCT A WOOD AND TARPAPER COVER WHICH WOULD SLANT FROM THE TOP OF THE CORNICE TO THE PLANE OF THE EXISTING ROOF. WHILE EMPLOYEE #1 HELD A PIECE OF WOOD IN PLACE ON THE CORNICE FOR EMPLOYEE #2 TO NAIL, THE CORNICE GAVE WAY AND EMPLOYEE #1 FELL. EMPLOYEE #2 TRIED TO CATCH HIM AND HE FELL ALSO. IT IS BELIEVED THAT EMPLOYEE #1 PUT TOO MUCH OF HIS WEIGHT ON THE CORNICE WHILE HOLDING THE WOOD. THE CORNICE COULD NOT SUPPORT THE WEIGHT OF A MAN AND WAS NOT STRONG ENOUGH TO ACT AS FALL PROTECTION EVEN IF IT HAD BEEN OF AN ADEQUATE HEIGHT. NO FALL PROTECTION WAS PROVIDED FOR THESE TWO MEN.
