Investigation Summary
On August 12, 1994, Employee #2 was working in a trench that was approximately 12 ft deep, 36 in. wide, and over 20 ft long, when dirt fell from the north wall and trapped his feet. Employee #1, who had been working for the employer for less than a week, jumped in the trench to help Employee #2. Moments later, the south wall of the trench collapsed on the employees, completely covering them with dirt. Rescue workers were able to dig a small hole toward Employee #2 to provide him with breathing air. Witnesses and rescue workers said they heard both employees yelling for help. Later, Employee #1 could not be heard. Employee #2 survived due to a pocket of air that surrounded him. Employee #1 died, and Employee #2 was hospitalized. The day before the accident, the general contractor had spoken to the employer regarding the safety of the trench. No apparent effort was made by the employer to protect his employees from cave-in hazards.
