Employee struck and killed by road paving truck

Employee #1 and other E. Lyme Highway Department employees were resurfacing a road by "chip setting," which involves spraying an emulsion on an existing road surface, then spreading a coating of stone chips over the emulsion and pressing it with rollers. While waiting to unload, Employee #1 and a dump truck driver were conversing by the rear passenger side of truck #8, which was parked in the westbound lane facing east. The emulsion spreader was in the eastbound lane, slowly moving west. The vehicles were parallel with 18 to 24 in. between them. The #8 truck driver walked around the back of his truck and entered it. Employee #1 walked between the vehicles and was in front of truck #8 when it began to advance. He was bumped by the right front bumper, lost his footing, and fell. Truck #8 ran up his inner left thigh and torso until the driver stopped and backed up in response to frantic signals. Employee #1 sustained crushed and exposed groin and pelvic areas and a ruptured bladder and intestines. He died about 7 hours after the incident. Employee #1 was shorter than 5 ft 3 in. The truck hood was 6 ft high. Truck #8 was a 1992 International, model 2554, 35,000 lb gross weight, in excellent condition. There was no explanation as to why Employee #1 walked between the vehicles and in front of truck #8.
