CONSTRUCTION EMPLOYEES STRUCK BY VEHICLE ON HIGHWAY

EMPLOYEES #1 AND #2 WERE INSTRUCTED TO REMOVE TEMPORARY TRAFFIC DETOUR MATERIALS (FLASHING ARROWBOARD UNIT AND CONES). THE ARROWBOARD UNIT HAD BEEN PLACED IN THE EAST NORTHBOUND LANE OF TRAFFIC RATHER THAN ON THE SHOULDER OF THE ROAD AS THEY SHOULD HAVE BEEN. EMPLOYEE #2 DROVE THE COMPANY-OWNED PICKUP TRUCK SOUTH AS EMPLOYEE #1 PICKED UP THE CONES AND PLACED THEM IN THE BED OF THE TRUCK. WHEN THEY REACHED THE FLASHING ARROWBOARD UNIT, EMPLOYEE #2 STOPPED THE TRUCK, TURNED, AND BACKED UP TO THE UNIT IN ORDER TO HOOK IT TO THE TRUCK. EMPLOYEE #2 STOOD ON THE WEST SIDE OF THE TRUCK WHILE EMPLOYEE #1 WALKED AROUND TO THE EAST. WHILE BOTH EMPLOYEES WERE BETWEEN THE TRUCK AND THE FLASHER UNIT A VEHICLE TRAVELLING NORTH AT ABOUT 50 MILES PER HOUR FAILED TO OBSERVE THE REMAINING WARNING CONES (LOCATED ABOUT 25 FEET SOUTH OF THE ARROWBOARD), RAN THROUGH THE CONES AND RAMMED THE FLASHING ARROWBOARD. EMPLOYEE #1 WAS KILLED WHEN HE WAS CRUSHED BETWEEN THE ARROWBOARD AND THE PICKUP TRUCK. EMPLOYEE #2 WAS KNOCKED UNDER THE BED OF THE TRUCK AND RECEIVED INJURIES FOR WHICH HE DID NOT NEED HOSPITALIZATION.
