EMPLOYEE STRUCK BY FALLING BUNDLE OF BOXES

EMPLOYEE #1 ENTERED A SHIPPING WAREHOUSE DEPARTMENT TO PICK UP 2 OR 3 LARGE BOXES STORED THERE. THE BOXES WERE STORED IN BUNDLES, EACH ABOUT 42 INCHES HIGH, 60 INCHES WIDE AND 50 INCHES DEEP, WEIGHING ABOUT 1600 POUNDS. THE EMPLOYEE DISMOUNTED HIS FORKLIFT TRUCK AND WAS STRUCK BY A BUNDLE WHICH FELL, WITHOUT WARNING, FROM A NEARBY STACK. (THE BUNDLES HAD BEEN STACKED 3 HIGH, UP TO A HEIGHT OF ABOUT 12 FEET.) THE EMPLOYEE HAD ON A HARD HAT, BUT IT OFFERED LITTLE PROTECTION FROM SUCH A HEAVY WEIGHT. THE EMPLOYEE DIED FROM A SEVERE SKULL FRACTURE. THERE WERE NO WITNESSES.
