CUT BY SAW BLADE

ON ABOUT JUNE 2, 1986, EMPLOYEE #1 WAS INSTRUCTED TO CLEAN PIECES OF SCRAP WOOD FROM UNDER A SAW WHICH WAS USED TO CUT STOCK FOR ROOF TRUSSES. THE SCRAP TAKE-AWAY MECHANISM ON THE SAW WAS INOPERATIVE. THE EMPLOYEE WAS INSTRUCTED TO ACCOMPLISH THE CLEANING BETWEEN CUTS, AND TO BE CAREFUL AROUND THE FOUR SAW BLADES. ON JUNE 10, 1986, EMPLOYEE #1 WAS REMOVING THE LAST SHOVELFUL OF SCRAP WOOD FROM UNDER THE SAW WHEN THE OPERATOR STARTED THE SAW. THE SAW BLADE CAUGHT THE SHOVEL HANDLE AND DRAGGED EMPLOYEE #1'S RIGHT HAND ACROSS THE SAW BLADE. EMPLOYEE #1 RECEIVED A SEVERE LACERATION AT THE KNUCKLE JOINT AND THE PALM OF HIS RIGHT HAND. THE ACCIDENT COULD HAVE BEEN PREVENTED IF THE EMPLOYER HAD INSTITUTED A LOCKOUT PROGRAM.
