Investigation Summary

On March 8, 1989, Employee #1 and a coworker were sweeping up leaves in a parking lot. The coworker was sweeping and raking the leaves into a pile while Employee #1 put the leaves in a container. The trash dumpsters were full, so Employee #1 took the container of leaves to empty at the creek. The concrete-lined creek contained 4 to 6 ft of water and had a bank pitch of approximately 60 degrees. A 4 ft high chain link fence ran along its banks. When approximately 5 to 10 minutes had passed, the coworker looked up to locate Employee #1 and the container. He saw the container, but not Employee #1 and surmised that the employee had gone to the rest room. When Employee #1 did not return at break time, the coworker asked if anyone had seen him. Employee #1 had apparently fallen into the creek and drowned.
