AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
AMERICAN FOUNDATION FOR SUICIDE PREVENTION,
CONSTRUCTION INDUSTRY ALLIANCE FOR SUICIDE PREVENTION, AND
STOP STIGMA TOGETHER

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) recognizes the value of maintaining a collaborative relationship to foster safety and health practices and programs to promote workplace mental health in American workplaces. To that end, OSHA and the American Foundation for Suicide Prevention (AFSP), together with the Construction Industry Alliance for Suicide Prevention (CIASP) and Stop Stigma Together (SST) as additional signatories, hereby renew the Alliance signed September 7, 2022, with a continued emphasis on providing employers, workers, and the public with information, guidance, and access to training resources that will help them promote workplace mental health and suicide prevention awareness and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA, AFSP, CIASP, and SST recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA’s National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in activities and initiatives related to workplace mental health and suicide prevention.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on workplace mental health and suicide prevention awareness, and communicate such information (e.g., via print and electronic media, other electronic assistance tools, and the AFSP, CIASP, OSHA, and SST websites). Ensure products developed encourage and reflect the diversity of the workforce, are accessible in multiple languages and formats, and encourage workers’ sense of belonging.
  • Speak, exhibit, or appear at conferences, local meetings and other events, such as OSHA’s Alliance Program Forum and Construction Roundtable, and AFSP, CIASP, and SST events.
  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on workplace mental health and suicide prevention awareness to help forge innovative solutions or to provide input on safety and health issues.
  • Share information among OSHA personnel and safety and health professionals regarding AFSP, CIASP, and SST’s best practices and effective approaches for promoting workplace mental health and suicide prevention awareness through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Collaborate with other Alliance participants on specific issues and projects on workplace mental health and suicide prevention awareness.
  • Facilitate relationships between OSHA’s National, Regional, and Area Offices and AFSP, CIASP, and SST to promote workplace mental health and suicide prevention awareness.
Training and Education

The Participants intend to work together to achieve the following objective:

  • Deliver or arrange for the delivery of workplace mental health and suicide prevention awareness and loss support programming to federal OSHA, State Plan, and On-Site Consultation Program personnel.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proved to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to discuss the responsibilities of the participants, to share information on activities, and to track results in achieving the goals of the Alliance. OSHA team members will include representatives of the Directorate of Cooperative and State Programs, the Directorate of Construction, and any other appropriate offices. OSHA will encourage State Plans’ and OSHA On-Site Consultation programs’ participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate their organization’s participation in the agreement for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of all signatories.

DE LA ADMINISTRACIÓN DE SEGURIDAD Y SALUD OCUPACIONAL DEL DEPARTAMENTO DEL TRABAJO DE LOS ESTADOS UNIDOS DE AMÉRICA

La oficina de Las Vegas de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Las Vegas ("el Consulado"), en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos reconocidos en la Carta de Arreglo entre la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos y la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 23 de agosto de 2024; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Nevada información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Nevada sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Nevada a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.
Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en el Consulado de Las Vegas y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".
Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Nevada para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSHA Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed Washington, D.C., on August 23, 2024; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Nevada and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Nevada regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Nevada to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in Nevada and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Nevada to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An Implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

      The Occupational Safety and Health Administration (OSHA) and the Consul General of Guatemala in Atlanta formed an Alliance to provide Guatemalan workers throughout the southeast with information, guidance, and access to training resources that will help them protect employees’ health and safety and allow them to exercise their rights fully.

1) First Georgia Multicultural Domestic Violence Candles Vigil in recognition of the 92 victims of domestic violence in 2023.

3) Seminar for the Victim Advocate’s Community of Practice at the National Immigrant Women’s Advocacy Project (NIWAP).

i The Georgia Farmworker Task Force is an advocacy group lead by the Farmworker Rights Division of the Georgia Legal Services. They advocate and represent farmworkers who are working and living unsafely because their employer is violating regulations in place to protect them. This group visits farms to inform workers of their rights; they also provide legal representation and inform the members of potential violations of existing laws. The Federal Agencies belonging to this group are there to provide resources and clarification of their regulations/jurisdictions/limitations and the non-profit organizations and Consulates are usually receiving employees’ complaints because the workers feel more comfortable speaking to them than a government agency.

OKLAHOMA CITY AREA OFFICE
AND
THE ASSOCIATED GENERAL CONTRACTORS OF OKLAHOMA BUILDING CHAPTER
AND
THE OKLAHOMA DEPARTMENT OF LABOR

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Oklahoma City Area Office, the Associated General Contractors of Oklahoma Building Chapter (AGCOK), and the Oklahoma Department of Labor OSHA Consultation (OSHA Consultation or ODOL) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and the Associated General Contractors of Oklahoma Building Chapter and the Oklahoma Department of Labor hereby renew the Alliance signed 12/18/2020, with a continued emphasis on health and safety in construction. Specifically, each organization is committed to providing the Associated General Contractors Oklahoma Building Chapter members and others with information, guidance, and access to training resources that will help them protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address fall, electrocution, excavation, struck by and caught in-between hazards.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and the Associated General Contractors Oklahoma Building Chapter recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, Consultation services, and opportunities to participate in the rulemaking process.

  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on construction safety to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  • To encourage worker participation in workplace safety and health by attending training sessions.

  • To share information on OSHA's National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.

  • To speak, exhibit, or appear at OSHA's, ODOL's, or AGCOK's conferences, local meetings, health fairs, or other events.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • To develop effective training and education programs for workers, supervisors, and administrators to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

  • To deliver or arrange for the delivery of the following courses: Fall Protection, Trenching and Excavation Safety including Competent Persons training, Electrical Safety, Silica Dust, Confined Space including Competent Person training, Hot and Cold Weather Exposure Safety, Crushing Hazards, Fire Extinguishers/Fire Safety, CPR (Instructor), and Hazard Communication (Supervisor/Administrator Training) courses.

OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization's products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Oklahoma City Area Office. OSHA will encourage OSHA On-Site Consultation programs' participation on the team.

This agreement will remain in effect for three years. Any signatory may terminate it for any reason at any time, provided they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of all signatories.
