Alliance Activities

  • January 17, 2014 – The new Alliance agreement was signed jointly with the new Sheet Metal and Air Conditioning Contractors National Association-Kansas City Chapter (SMACNA-KC) Partnership agreement. Approximately15 people were in attendance.
  • January 28, 2014 – The Kansas City Area Office staff and the Regional Labor Liaison attended the monthly SMACNA-KC safety committee meeting, where Local 2 members were also in attendance. 14 people were in attendance.
  • February 7, 2014 – The Kansas City Area Office CAS and the Regional Labor Liaison provided information on the new alliance and partnership during a Lunch and Learn event at the Local 2 facility in Raytown, MO. 13 people were in attendance.
  • February 18, 2014 – The Kansas City Area Office CAS, the Regional Labor Liaison and the Regional Partnership/Alliance Coordinator attended the SMACNA-KC Live Trade Show in Kansas City, MO. Approximately 150 people were in attendance.
  • February 28, 2014 – The Regional Labor Liaison provided an OSHA presentation, which included the labor liaison role, during a first year apprenticeship course at the Local 2 facility in Raytown, MO. 17 people were in attendance.
  • April 2, 2014 – The Regional Labor Liaison met with two union representatives to visit a job site regarding a potential fall hazard.
  • October 24, 2014 – The Kansas City Area Office CAS and the Regional Labor Liaison attended the monthly SMACNA-KC safety committee meeting, where Local 2 members were also in attendance. 9 people were in attendance.
  • November 7, 2014 – The Regional Labor Liaison met with two union representatives to discuss the formation of a union safety committee.
  • November 21, 2014 – The Kansas City Area Office CAS and the Regional Labor Liaison attended the monthly SMACNA-KC safety committee meeting, where Local 2 members were also in attendance. Attending the meeting was the new apprenticeship coordinator. 10 people were in attendance.
  • January 13, 2015 – The Kansas City Area Office CAS provided the 2-hour ‘Intro to OSHA’ module during an OSHA 10-hour Construction Outreach Training course provided to Apprentices at the Local 2 facility in Raytown, MO. 35 people were in attendance.

Upcoming Plans

This Alliance is complimentary to the SMACNA-KC Chapter Partnership. The SMACNA Partnership provides the “management commitment” and the Sheet Metal Workers Union Local #2 Alliance provides the “employee involvement” elements necessary to change the culture of this industry, in accordance with the elements of an effective safety and health management system as set forth in the “1989 Voluntary Guidelines for and Effective Safety and Health Management System”. This dynamic interaction of the Alliance with the Partnership should serve as a model for future cooperative efforts within an industry.

Future plans are to continue to support the Sheet Metal Worker Local #2 with its efforts to provide enhanced OSHA 10- and/or 30-hour safety and health training to their Apprentices, as part of the Union Apprenticeship program. Additionally, we plan to provide training sessions on specific needs to their Journeyman level Union members.

    The Great Plains OSHA Education Center consortium will continue to support the Alliance Agreement with the OSHA Region 7. Activities will be include the above objectives. AND
THE CONSULATE OF MEXICO IN KANSAS CITY, MISSOURI


The U.S. Department of Labor's (DOL) Occupational Safety and Health Administration (OSHA), Kansas City, Missouri Regional Office, and the Kansas City, Missouri, St. Louis, Missouri, and Wichita, Kansas Area Offices and the Consulate of Mexico in Kansas City, Missouri, hereinafter referred to collectively as "the Participants";

Recognizing the joint commitment to protect workers' rights for Mexican workers acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on June 1, 2010; and

Recognizing that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

 

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Missouri and Kansas information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

 

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Missouri and Kansas regarding workplace safety and health, and to communicate such information to constituent employers and workers.
  • To develop training and education programs for Mexican workers and Mexican employers in Missouri and Kansas to promote understanding of workers' rights and responsibilities of employers, including the use of the OSHA complaint process, and to communicate such information to employers and workers.

 

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate of Mexico in Missouri and Kansas' Web site) to Mexican Nationals working in Missouri and Kansas and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

 

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a national dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Missouri and Kansas to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This Arrangement is intended to cease two years from the date of signing. A Participant should endeavor to provide 30 days advance written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time with the concurrence of the Participants.

    The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Missouri and Kansas information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational safety and health, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

    Although there have been no formal meetings, several informal telephone conversations with some of the parties have been held throughout the evaluation period to discuss innovative ways to broaden the Hispanic community awareness of safety and health.

      • No activity to report during the evaluation period.
    • Outreach and Communication
      • In conjunction with the Alliance, a Kansas City Area Office Assistant Area Director (AAD) (Spanish-speaking), Compliance Officer (Spanish-speaking), and/or the Compliance Assistance Specialist (CAS) visited the Mexican Consulate facility nine times to participate in the monthly outreach event at the facility. During this participation, the area office staff spoke with Mexican Nationals about OSHA, workers’ rights, and the OSHA complaint process, and provided publications. The average number of attendees per visit was approximately 54 people, impacting approximately 490 people. During the year, the same AAD conducted 1 taped radio show to talk about general OSHA information, workers’ rights, and the complaint process. This radio session is primarily for the Hispanic community in and around Garden City, KS, reaching Latinos in southeast Kansas, Colorado, Oklahoma, and Texas. In addition, the Wichita Area Office Compliance Assistance Specialist (CAS) participated in three mobile Consulate activities in Kansas. The specific activities have included:
        • March 9, 2015– The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 90 people were in attendance.
        • April 3, 2015 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 45 people were in attendance.
        • May 30, 2015 – The Wichita Area Office CAS provided a booth during the mobile Consulate event in Garden City, KS. 200 people were in attendance.
        • May 11, 2015 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 45 people were in attendance.
        • June 8, 2015 – A Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 55 people were in attendance.
        • July 13, 2015 – A Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 30 people were in attendance.
        • August 17, 2015 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 40 people were in attendance.
        • September 4, 2015 – The Kansas City Area Office AAD provided a presentation on incident prevention during the 2015 Labor Rights Week activities at the Consulate facility. 50 people were in attendance.
        • September 4, 2015 – The Kansas City Area Office AAD participated in a Spanish radio program (associated with the Mexican Consulate) on La K Buena Radio (105.9 FM) in the Garden City, KS area. The presentation included general OSHA information, workers’ rights and the complaint process. The radio station has a base audience of approximately 20,000 listeners.
        • October 24, 2015 - The Wichita Area Office CAS provided a booth during the mobile Consulate event in Garden City, KS. 75 people were in attendance.
        • November 19, 2015 – A Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 90 people were in attendance.
        • December 11, 2015 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 45 people were in attendance.
        • January 11, 2016 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers’ rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 50 people were in attendance.
        • February 26, 2016 – The Wichita Area Office staff met the new Vice Consul with the Mexican Consulate-Kansas City.
        • February 27, 2016 – The Wichita Area Office CAS provided a booth during the mobile Consulate event in Wichita, KS. 50 people were in attendance.

     

    Promoting the National Dialogue on Safety and Health

    • During the evaluation period, there were no referrals from the Mexican Consulate-Kansas City

     

    Alliance Products

    No new products were developed. However, many OSHA bilingual publications have been provided (although not tracked) to the Mexican Consulate to be placed in their waiting area during this evaluation period and for their mobile consulates.

  4. Results

     

    During this evaluation period, the alliance has brought together the signatory groups as well as other community organizations that interact with the Hispanic population in the greater Kansas City area, as well as in Kansas and Missouri.

El Consulado de México en Kansas City, Missouri ("el Consulado") y la Oficina Regional de Kansas City, Missouri y las Oficinas de Áreas de Kansas City, Missouri, St. Louis, Missouri, y Wichita, Kansas, de la Administración de Seguridad y Salud Ocupacionales (OSHA) del Departamento de Trabajo de los Estados Unidos de América, y en adelante denominados colectivamente "los Participantes";

Reconociendo el compromiso conjunto de proteger los derechos laborales de los trabajadores mexicanos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacionales (OSHA) del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D. C., el 1 de junio de 2010; y

Reconociendo que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines talles como la capacitación y educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

 

Objetivo general

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos en Missouri y Kansas información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarles a entender los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales.

 

Capacitación y educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Missouri y Kansas sobre la seguridad y la salud en el lugar de trabajo, y comunicar dicha información a los empleadores y trabajadores en cuestión.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Missouri y Kansas a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores, incluyendo el uso del procedimiento de quejas de OSHA, y comunicar dicha información a los empleadores y trabajadores.

 

Difusión y comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre reconocimiento y prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado) a los nacionales mexicanos que trabajan en Missouri y Kansas y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

 

Promoción de un diálogo nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo nacional sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Missouri y Kansas para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores.

Un grupo de aplicación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Se tiene la intención de que el presente Arreglo cese a los dos años de la fecha de suscripción. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con 30 días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento con el consentimiento de los Participantes.

AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

AND
GREAT PLAINS OSHA EDUCATION CENTER (CONSORTIUM)


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Kansas City Region VII (including the Regional Office, and the Des Moines, Kansas City, Omaha, St. Louis, and Wichita Area Offices) and Great Plains OSHA Education Center [Consortium, which is comprised of the Metropolitan Community College (Kansas City, MO), St. Louis University College for Public Health and Social Justice (St. Louis, MO), Barton Community College (Grandview Plaza, KS), and the various host sites] recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and the Great Plains OSHA Education Center in Region VII hereby form an Alliance to provide the OSHA Education Center students and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to prevalent health and safety hazards in general and construction industries, and enhancing their understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In developing this Alliance, OSHA and the Great Plains OSHA Education Center in Region VII recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following objectives related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • To coordinate with Field Federal Safety and Health Councils by hosting meetings and providing instructors at meetings.
  • Collectively assessing the employer training needs in Region VII and the geographical distribution of host sites for the OSHA Education Center.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication objectives:

  • To speak, exhibit, and/or appear at OSHA Education Center courses, safety and health conferences, local association meetings, Region VII VPPPA Conference, Field Federal Safety and Health Council meetings, and other related events.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the OSHA Kansas City Regional Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of all signatories.

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on November 6, 2014; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Kansas and Missouri, and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Kansas and Missouri regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Kansas and Missouri to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in Missouri and Kansas and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Kansas and Missouri to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

    Although there have been no formal meetings, several informal telephone conversations with some of the parties have been held throughout the evaluation period to discuss innovative ways to broaden the Hispanic community awareness of safety and health.

  3. Activities and Products

    Alliance Activity

    • Training and Education

      No activity to report during the evaluation period.

    • Outreach and Communication

      In conjunction with the Alliance, a Kansas City Area Office Assistant Area Director (AAD) (Spanish-speaking), Compliance Officer (Spanish-speaking), and/or the Compliance Assistance Specialist (CAS) visited the Mexican Consulate facility nine times to participate in the monthly outreach event at the facility. During this participation, the area office staff spoke with Mexican Nationals about OSHA, workers' rights, and the OSHA complaint process, and provided publications. The average number of attendees per visit was approximately 60 people, impacting approximately 540 people. During the year, the same AAD conducted 2 live radio shows to talk about general OSHA information, workers' rights, and the complaint process. These radio sessions are primarily for the Hispanic community in Kansas City, MO and Kansas areas. Approximately, 125,000 Spanish-speaking people have been impacted through these events, which are often re-broadcasted several times. The specific activities have included:

      • March 10, 2014 – The Kansas City Area Office AAD and CAS provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 60 people were in attendance.
      • April 14, 2014 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 50 people were in attendance.
      • April 28, 2014 – The Mexican Consulate-Kansas City Consul spoke during the annual Workers' Memorial Day event held at the Builders' Association Training Facility in North Kansas City, MO. Approximately 150 people were in attendance.
      • May 15, 2014 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the 2014 Latino Summit at the Consulate facility. 50 people were in attendance.
      • June 9, 2014 – A Kansas City Area Office Compliance Officer provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 85 people were in attendance.
      • July 14, 2014 – A Kansas City Area Office Compliance Officer provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 60 people were in attendance.
      • August 11, 2014 – The Kansas City Area Office CAS provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 50 people were in attendance.
      • August 24, 2014 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the 2014 Labor Rights Week activities held at the Consulate facility. Approximately 75 people were in attendance.
      • August 24, 2014 – The Kansas City Area Office AAD participated in a Spanish radio program (associated with the Mexican Consulate) on Radio Luz (1480 AM) in the Kansas City area. The presentation included general OSHA information, workers' rights and the complaint process. The radio station has a base audience of approximately 25,000 listeners.
      • November 10, 2014 – A Kansas City Area Office Compliance Officer provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 50 people were in attendance.
      • November 17, 2014 – The Kansas City Area Office AAD participated in a Spanish radio program (associated with the Mexican Consulate and the Kansas City Spanish Chamber of Commerce) on La Gran D Radio Station (1340 AM) in the Kansas City area. The presentation included general OSHA information, workers' rights, and the complaint process. The radio station has a base audience of approximately 100,000 listeners.
      • December 8, 2014 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 25 people were in attendance.
      • February 9, 2015 – The Kansas City Area Office AAD provided a booth and a presentation on general OSHA information, workers' rights and the complaint process during the monthly outreach event at the Mexican Consulate facility. 85 people were in attendance.
    • Promoting the National Dialogue on Safety and Health

      The following referrals from the Mexican Consulate-Kansas City were received during the evaluation period:

      • June 14, 2013 – A Fork truck hazard in a Kansas City, KS warehouse (who employees approximately 28) was reported by the Consulate on behalf of a former worker. The worker was fired after an accident (involving a fork truck the worker was driving fell between the truck the worker was loading and the dock) in April 2013. Fortunately, the worker was not hurt. Since the worker did not report the incident until more than 30 days after the retaliation, the worker could not be helped under 11C protection. However, the Wichita Area Office processed the complaint, under several Local Emphasis Programs, and found no violations during the on-site inspection.
      • June 19, 2013 -Trench hazards were reported from a worker through the Consulate; however, OSHA had no jurisdiction since the worker was employed by a city. The Kansas City Area Office Duty Office contacted the City Water Service Department (WSD) to ensure that employees working inside of trenches were protected from cave-in hazards. A positive response was received from the WSD, regarding the protection of these workers.
      • January 22, 2014 – Numerous serious hazards were reported by a worker through the Consulate, at a pallet manufacturing shop in Kansas City, KS, employing approximately 42 workers. The referral was forwarded to the Wichita Area Office, who initiated a formal inspection. Violations for lack of machine guarding, and deficiencies regarding the hazard communication, personal protective equipment and fork truck standards, were issued on Feb. 10, 2014. The receipt of the violations has yet to be acknowledged.

    Alliance Products

    No new products were developed. However, many OSHA bilingual publications have been provided (although not tracked) to the Mexican Consulate to be placed in their waiting area during this evaluation period and for their mobile consulates.

  4. Results

    During this evaluation period, the alliance has brought together the signatory groups as well as other community organizations that interact with the Hispanic population in the greater Kansas City area, as well as in Kansas and Missouri.

  5. Upcoming Milestones

    The partners in the alliance wish to renew the alliance, and a draft is currently under review. The area offices will be available to support the mobile Consulate locations throughout Missouri and Kansas, when available. In addition to this support for the mobile Consulate, the area offices plan to support the Labor Rights Week activities and other community activities, including the BiNational Health Week events.

La Oficina Regional de Kansas City, Missouri y las Oficinas de Área de Kansas City, Missouri, Saint Louis, Missouri y Wichita, Kansas, de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Kansas City, Missouri (el Consulado), en adelante denominados conjuntamente “los Participantes”;

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D.C., el 6 de Noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Missouri y Kansas información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Missouri y Kansas sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Missouri y Kansas a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Missouri y Kansas y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Missouri y Kansas para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres (3) veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

Associated General Contractors Join with OSHA to Form Safety and Health Alliance First Midwest Alliance with AGC

OMAHA, Neb. – Ensuring safety and health for employees in the construction industry is the goal of a new alliance between the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) and the Associated General Contractors of America (AGC). A signing ceremony will be held Oct. 15 in Lincoln, Neb.

OSHA Health and Safety alliances are part of U.S. Labor Secretary Elaine L. Chao’s ongoing efforts to improve the health and safety of workers. OSHA alliances provide an opportunity to participate in a cooperative relationship with OSHA for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health.

"This alliance is the first Midwest effort with this organization," said Charles E. Adkins, CIH, OSHA regional administrator in Kansas City.

The alliance will provide information, guidance and access to training resources to protect the health and safety of over 2,000 member employees in Nebraska, particularly in reducing and preventing exposure to falls, electrocutions, struck-by, caught-in and construction amputation hazards. Participants in the alliance are the AGC of America-Nebraska Building Chapter, OSHA, and the Nebraska Department of Labor-Workforce Development OSHA Consultation.
