    Overview

    Through the Alliance, OSHA and SCA will provide SCA members and others in the shipbuilding industry, including non-English or limited-English speaking employees, with information and guidance that will help them protect employees' health and safety, particularly in reducing and preventing exposure to shipyard safety and health hazards such as electrical, welding/hotwork, ergonomics, and in promoting hearing conservation.

      Outreach and Communication Goals

      • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and SCA's Web sites) to employers and employees in the [maritime] industry.

      Products

      OSHA and SCA Alliance Web Page

      OSHA is continuing to update the OSHA and SCA Alliance Web page that is posted on the Agency’s Web site. The page includes OSHA and SCA Alliance-related information, including links to the OSHA and SCA Alliance agreements, news releases, Alliance Program participant-developed products, activities and events, and milestones and successes.

      SCA and OSHA Web Site

      SCA continues to update the association’s Web site, which includes information on the OSHA and SCA Alliance, OSHA Region X and SCA Alliance, and the OSHA Region VI Houston North and South Area Offices – SCA Strategic Partnership. During the reporting period, SCA posted “Safety Alert: Welding and Other Hot Work Procedures in Shipyard Employment” and “Toolbox Talks: Hearing Conservation in the Shipbuilding Industry,” developed through the OSHA and SCA, ASA, NSRP, American Society of Safety Engineers (ASSE), and American Industrial Hygiene Association (AIHA) Alliances, on its Web site.

      Publications and Newsletters

      Articles on the OSHA and SCA Alliance activities have appeared in a number of print and online publications, including SCA Press Releases, OSHA up to Date, Occupational Health & Safety Magazine, and EHS Today. In addition, SCA includes information on OSHA compliance assistance resources in its quarterly publication, Shipyard Chronicle. For more information see the “Alliance Program Reach” table.

      OSHA Safety and Health Topics Pages and eTools

      SCA representatives serve on the editorial boards for the following Safety and Health Topics pages on the OSHA Web site: Maritime Industry and Ship Building and Repair. SCA representatives also serve on the editorial board of the Shipyard Employment eTool.

      • Speak, exhibit, or appear at OSHA's and SCA's conferences and events, such as SCA's bi-annual Safety Seminar.

      SCA Safety Seminar, September 10, 2009, Sturgeon Bay, Wisconsin

      Kelly Bubolz, Compliance Assistance Specialist, Region V, Appleton, Wisconsin Area Office, USDOL-OSHA, delivered a maritime safety-related presentation and provided an update on OSHA’s maritime-related activities to 35 people during the SCA Safety Seminar on September 10, 2009, in Sturgeon Bay, Wisconsin.

      • Share information among OSHA personnel and industry safety and health professionals regarding SCA best practices or effective approaches and publicize results through outreach by SCA and through OSHA- or SCA-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

      National Safety Congress and Expo, October 27, 2009, Orlando, Florida

      Stephen Butler, Director, Office of Maritime Enforcement, DEP, USDOL-OSHA and Ian Bennitt, Manager, Government Affairs, SCA, delivered "Maritime Industry Safety and Health Products and Information" to 35 people at the 2009 NSC Congress and Expo on October 27, 2009, in Orlando, Florida. The presentation also included an update on the activities of the OSHA and SCA Alliance.

      • Work with other Alliance participants on specific issues and projects including shipyard employment safety issues that are addressed and developed through the Alliance Program.

      Products

      Safety Alert: Welding and Hot Work Procedures in Shipyard Employment

      Through the Alliance Program, SCA worked with representatives from ASA, NSRP AIHA, and ASSE Alliances to develop “Safety Alert: Welding and Hot Work Procedures in Shipyard Employment.” The Alert provides tips and reminders to help maintain a safe work environment by identifying situations and hazards associated with hot work. The Safety Alert was posted on the SCA Web site in February 2009 and linked to from the OSHA and SCA Alliance Web page and the Alliance Program Participants Developed Products Web page on the OSHA Web site.

      Toolbox Talks: Hearing Conservation in the Shipbuilding Industry

      Through the Alliance Program, SCA worked with representatives from ASA, NSRP AIHA and ASSE Alliances to develop “Toolbox Talks: Hearing Conservation in the Shipbuilding Industry.” The toolbox talks address a number of hearing conservation-related topics, including shipbuilding noise levels and selecting hearing protection. The toolbox talks also include a hearing protection checklist for workers in shipyard employment. The documents were posted on the SCA Web site in April 2009 and linked to from the OSHA and SCA Alliance Web page and the Alliance Program Participants Developed Products Web page on the OSHA Web site.

      • Promote and encourage SCA members' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, and the On-site Consultation Program and its Safety and Health Achievement Recognition Program. During this evaluation period, no products or resources have been developed to meet this Alliance goal.

      Promoting the National Dialogue on Workplace Safety and Health Goals

      • Convene or participate in forums, roundtable discussions, or stakeholder meetings on shipyard safety and health hazards, including ergonomics, to help forge innovative solutions in the workplace.

      Events

      North American Occupational Safety and Health (NAOSH) Week, May 3-9, 2009, “Safety Means Always Coming Home”

      On May 3-9, 2009, SCA and 57 other Alliance Program participants supported 2009 NAOSH Week. Sponsored annually by ASSE, an Alliance Program participant, and the Canadian Society of Safety Engineering (CSSE), the Week focuses on the importance of preventing injuries and illnesses in the workplace. The theme for 2009 NAOSH Week was "Safety Means Always Coming Home." Ian Bennitt, Manager, Government Affairs, SCA, attended the event and represented SCA, which, along with a number of other Alliance Program participants, supported the Week.

    2. Executive Summary

      Through the Alliance Program, OSHA and SCA continue to work together to address safety and health issues in the maritime industry and continue their productive working relationship. For example, the OSHA and SCA Alliance worked on several projects with ASA, NSRP, and other maritime industry-related Alliances to develop a safety alert and toolbox talk focusing on safety and health issues in shipyard employment.

      OSHA and SCA representatives are also sharing their expertise through participation on the OSHA electronic assistance tools’ editorial boards and speaking opportunities. SCA representatives continue to serve on the Maritime Industry and Ship Building and Ship Repair Safety and Health Topics pages’ editorial boards and the Shipyard Employment eTool’s editorial board. In addition, at the SCA Safety Seminar on September 10, 2009, in Sturgeon Bay, Wisconsin, Kelly Bubolz, Compliance Assistance Specialist (CAS), Region V, Appleton, Wisconsin Area Office, USDOL-OSHA, delivered a maritime safety-related presentation and provided an update on OSHA’s maritime-related activities. Further, representatives from DEP and SCA delivered a safety and health presentation focusing on maritime safety at the 2009 NSC Congress and Expo in Orlando, Florida.

      Through the Alliance Program, SCA worked with ASSE and more than 55 other Alliance Program participants to support and promote 2009 NAOSH Week, May 3-9, “Safety Means Always Coming Home.”

      Lastly, SCA is continuing to hold joint Implementation Team meetings with ASA and NSRP, which include OSHA representatives from DCSP, DEP, DSG, and DTSEM.

  4. Upcoming Milestones

    To build on the success of the Alliance’s first seven years, the OSHA and SCA Alliance was renewed in March 2009. To meet the goals of the renewed cooperative agreement, the Alliance Implementation Team will be working on a number of compliance assistance activities and products for the maritime industry. For example, SCA will work with ASA, NSRP, AIHA and ASSE through the Alliance Program to finalize a safety alert focusing on ventilation safety-related issues in shipyard employment. SCA representatives will review and provide feedback on an OSHA Safety and Health Information Prevention Sheet (SHIPS) focusing on rigging. SCA representatives will also review and provide feedback on OSHA-developed products, including a series of maritime-related fatality fact sheets and QuickCards focusing on aerial lifts.

    Through the OSHA Region IV Mobile, Alabama Area Office and Gulf Coast Safety Maritime Safety Association Alliance, members from SCA will review and provide feedback on draft compliance assistance and outreach documents focusing on safety and health issues in the maritime industry.

    In addition, SCA representatives will continue to serve on the OSHA Maritime Industry and Ship Building and Ship Repair Safety and Health Topics pages’ editorial boards and the OSHA Shipyard Employment eTool’s editorial board.

    Further, SCA will support 2010 NAOSH Week, “Mission NAOSH 2010: Safe Workplaces” and will promote the Alliance Program and Agency compliance assistance materials.

    SCA will publish articles in its quarterly publication, Shipyard Chronicle, and include Alliance-related information in the “News and Public Information” section on its Web site. In addition, SCA will post the products the Alliance develops to the association’s Web site which will be linked to from the OSHA and SCA Alliance Web page and the Alliance Program Participants Developed Products Web page on the Agency’s Web site.

    John Vos, CAS, Region IV, Savannah Area Office, USDOL-OSHA, will deliver a presentation focusing on maritime health and safety issues at the SCA Spring Health and Safety Seminar on March 11, 2010, in Mobile, Alabama.

    Finally, OSHA is working with ASA, NSRP, and SCA to conclude the individual Alliances and sign one maritime-related cooperative agreement in August 2010 that will address the same goals and safety and safety and health topic areas.

    1) Sheridan Construction provided OSHA 10-hour training to five (5) high school seniors from Peach County High School.

    2) Baston-Cook Construction hosted 120 students from Cass High School at its Cartersville Medical Center construction site. Students had the opportunity to witness first-hand a wide range of crafts, as well as the importance of safety.

    3) RW Allen Construction hosted students from Lincoln County High School at its Presbyterian Village Center construction site. Students had the opportunity to witness first-hand a wide range of crafts, as well as the importance of safety.

    4) Bowen & Watson Construction hosted students from Stephens County High School at its CTAE facility construction site. Students had the opportunity to witness first-hand a wide range of crafts, as well as the importance of safety.

    5) Central Georgia Technical College and MetroPower formed an apprenticeship program.

    6) During this period, ACE Electric implemented an apprenticeship program through Wiregrass Georgia Tech.

AGREEMENT RENEWING THE ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE SHIPBUILDERS COUNCIL OF AMERICA

The Occupational Safety and Health Administration (OSHA) and the Shipbuilders Council of America (SCA) hereby renew the Alliance agreement signed January 31, 2003 and renewed June 16, 2005. OSHA and SCA will continue to provide SCA members and others in the shipbuilding industry including non-English or limited English speaking employees, with information and guidance that will help them protect employees' health and safety, particularly in reducing and preventing exposure to shipyard safety and health hazards such as ergonomics. In renewing this Alliance, OSHA and SCA recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA and SCA will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and SCA's Web sites) to employers and employees in the industry.

  • Speak, exhibit, or appear at OSHA's and SCA's conferences and events, such as SCA's bi-annual Safety Seminar.

  • Share information among OSHA personnel and industry safety and health professionals regarding SCA best practices or effective approaches and publicize results through outreach by SCA and through OSHA- or SCA-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

  • Promote and encourage SCA members' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, and the On-site Consultation Program and its Safety and Health Achievement Recognition Program.

OSHA and SCA will work together to achieve the following goal related to promoting the national dialogue on workplace safety and health:

  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on shipyard safety and health hazards, including ergonomics, to help forge innovative solutions in the workplace.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorates of Cooperative and State Programs, Enforcement Programs, Standards and Guidance, and Science, Technology and Medicine and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.

    3. Overview

      The goals of this Alliance is to provide MNA members and others with information, education, guidance, and access to resources that will help them protect the health and safety of nurses and healthcare workers, particularly by reducing and preventing exposure to workplace violence and abuse, back and other musculoskeletal work- related injuries, slip, trip and fall hazards; latex allergens, air contaminants, and pathogens, and infection control. Provide information and assistance with filing OSHA complaints and understanding their rights and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

  2. Implementation Team Meetings

    In addition to these formal meetings, the Alliance coordinators from both groups maintained regular contact throughout the reporting period to monitor the Alliance’s progress and results.

    Minutes of May 22, 2019 Meeting at the MNA in Canton – Alliance Meeting #2- Follow-up to meeting in October 2018 planning alliance events. At this meeting introduced to Peg Taylor, Assistant Director of Health and Safety. Discussed improving and set goals with training presentations to union officials on improving MNA safety and health complaint process, and streamlining communication between MNA and OSHA. Created an OSHA complaint process on MNA website.

    Braintree Office developed and sent to about 75 nursing schools and colleges in Massachusetts, a letter with OSHA resources and links to workplace safety and health resources, including information on workplace violence, to raise awareness of these issues to the health care students prior to entering their nursing profession.

    All Day MNA Conference held in October 02, 2019 at Lombardo’s in Randolph – Focused on work place violence and sexual harassment with 100 hundred attendees.

    May 28, 2019, Labor AD’s evening meeting Northshore Regional office in Lynnfield, MA, OSHA CAS presented and informed members on their rights on how to file an OSHA Complaint. – completed for 28 MNA Union Area Directors.

    OSHA Summer Summit at UMass Amherst on June 19, 2019. Chris Pontus, Judith Pare and Peggy Taylor registering and attended. This collaboration promotes sharing of safety and health learning with involvement in MNA and OSHA sponsored conferences.

    Winter Conference, typically MNA does not do training and conference during winter months, but planned a January 2020 conference at UMass Dartmouth/UMass Worcester a winter conference focusing on: Toxicology, Ergo, and Workplace Violence.

    May 24, 2019. Thank you again, for meeting with us and collaborating on potential projects with MNA. This morning I presented the idea of an OSHA training for our Labor A.D.s and our leadership team was thrilled with the prospect! Julie has asked me to reach out to you and request that you put a hold on September 5th as a potential training date. Julie and Roland will be meeting with the labor staff on June 6th to make sure that there are no conflicts with the September date.

    Occupational Safety & Health Administration presented to the Labor School on May 27, 2019 in Lynnfield, MA on employee rights and the OSHA complaint and whistleblower protection and procedures. About 25 Union Area Directors representing various hospitals in Eastern Massachusetts attended.

    Occupational Safety & Health Administration presented to the Labor School on June 17, 2019 in Canton, MA on employee rights and the OSHA complaint and whistleblower protection and procedures. About 30 Union Area Directors representing various hospitals in Eastern Massachusetts attended.

    The MNA Division of Labor met this morning and asked me to extend a formal invitation to you. MNA staff very interested in learning about strategies for communicating and reporting safety and health complaints to OSHA. In order to maximize attendance at this meeting we would like to schedule you for Thursday, October 3rd, 11:00 AM-12:00 PM at MNA Headquarters.

    Approximately 20 MNA Hospital Labor Representatives attended the OSHA presentation at the MNA headquarters in Canton, MA. The OSHA presentation was conducted on October 03, 2019 on better understanding and improving the OSHA complaint process with their members. A guideline fact sheet on the OSHA complaint process was handed out.

    January 2020, Peter Barletta and Chris Pontus commenced developing a specific OSHA -10 hour curriculum for nurses and healthcare providers. The plan is to conduct the OSHA-10 hour healthcare in the spring and fall, opened for MNA and non MNA members in the healthcare community. The OSHA -10 hour would focus on infection control and bio hazards, PPE, blood borne, needle stick, workplace violence, slip trips, falls and ergonomics, while maintaining the core OSHA-10 hour requirements under DTE regulations.

    February – April 2020- Covid-19, OSHA Braintree office provided technical assistance by hand delivering in February OSHA’s Pandemic Influenza publications for their nurses. Approximately 100 of these books were delivered to the MNA headquarters in Canton, MA, to be distributed to their approximately 83 hospitals and healthcare facilities in Massachusetts. In addition OSHA emailed all the current and up to date Covid-19 links, including respirators and fit testing guidelines regarding OSHA respiratory protection, CDC, and NIOSH links.

    The OSHA Andover, Braintree and Bridgeport CAS’s PPE donation coordinated and facilitated with alliances partners LaMar Advertising and MNA. LaMar, through the OSHA Bridgeport alliance, volunteered and offered in providing free digital billboard space at 12 locations in Massachusetts for advertising the MNA PPE donation drive. Also MNA developed a flyer for their PPE donation drive, which sent to OSHA alliances and stakeholders interested in donating PPE to front line nurses and health care providers in Massachusetts. The coordinated PPE drive has been successful with a number of organizations and companies donating KN95 Respirators, and other desperately needed PPE.

    Spring 2020 – Regional 5 Program – 2 ½ hours on ergonomics and safe patient handling Clinical Conference in May 2020 with 500-700 attendees for license renewal. Breakout sessions 90 minutes would like OSHA to present on Workplace Violence.

    Other Topics:

    Task Force Groups - develop task force group on workplace violence?

    MassCosh Grant - Risk assessment on substance abuse and opioids. Working with Teamsters and Iron Workers.

    Develop an OSHA template and handouts on how to properly and adequately file a detailed factually strong OSHA Complaint. Maybe publish an article in the Mass Nurses Newsletter and MNA website.

    Discussed OSHA’s letter to the Nursing Schools on workplace violence. Judith Pare recommended reaching out to the Nursing Honor Societies and the UMass honor Society and OSHA presenting and bringing speakers and topics. They would have strong interest. Also reach out to Student Nurses Association- IODIFY- Assumption College.

  3. Evaluations

    This alliance has been very successful in training nurses and healthcare providers on their rights on the job with a better understanding of OSHA’s and MNA role in more efficiently and effectively communicating and processing safety and health complaints.

  4. Upcoming Milestones

    List major planned activities, products, and issues that the Alliance plans to work on during the next reporting period, including plans for renewal or conclusion.

    The plan is to continue the OSHA-MNA Alliance in further developing safety and health educational products, presentations, and curriculums for their membership. Continue providing on going Covid-19 resources and technical information to all their nurses and health care providers in better protecting themselves and reducing risk of exposure while treating patient with Covid-19.

    Development of an OSHA-10 hour program specifically focusing on the safety and health training needs of healthcare workers. That will improve their knowledge of their rights under the OSHA Act, and increase their understanding of the various OSHA tools available to improve their working conditions, ensuring employers comply with all pertinent OSHA safety and health standards.

    Continued focusing on reducing injuries resulting from Work Place Violence through communication and training of best practices which employers would be able to implement at their facility.

    • Speech/Presentation: Speeches or presentation by OSHA staff at events sponsored by the Alliance participant.
    • Training: This includes best practice seminars or other training that Alliance participants provide for OSHA staff. It also includes training for workers/employers/others by Alliance participants.

      The Occupational Safety and Health Administration (OSHA), the Southeastern Line Constructors Chapter of the National Electrical Contractors Association (SLCC/NECA), the International Brotherhood of Electrical Workers (IBEW) 5th and tenth districts, and the Southeastern Line Constructors Apprenticeship and Training (SELCAT) work cooperatively to provide workers and others with information, guidance, and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to electrical transmission and distribution equipment hazards
