Subject: 29 CFR 1926.902(d) Proposed Modifications to Explosives and Blasting Agents and Surface Transportation of Explosives

1. Purpose

The purpose of this directive is to provide advisory information and guidance on proposed future changes to 29 CFR 1926.902(d).

2. Documentation Affected

OSHA construction standards do not apply to highway transportation of explosives.

OSHA requirements are set by statute, standards and regulations. Our interpretation letters explain these requirements and how they apply to particular circumstances, but they cannot create additional employer obligations. This letter constitutes OSHA's interpretation of the requirements discussed. Note that our enforcement guidance may be affected by changes to OSHA rules. Permissibility of transporting blasting caps with other explosives in the same vehicle where an IME 22-1993 container is used.
