EL CONSULADO DE MÉXICO EN AUSTIN, TEXAS

La Oficina de Área en Austin, Texas de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Austin, Texas (“el Consulado”), en adelante denominados conjuntamente “los Participantes”;

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos reconocidos en la Carta de Arreglo entre la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos y la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 2 de septiembre de 2021; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en en Austin, Texas, incluyendo los condados de Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis, y Williamson en el área central de Texas información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en en Austin, Texas, incluyendo los condados de Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis, y Williamson en el área central de Texas sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en en Austin, Texas, incluyendo los condados de Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis, y Williamson en el área central de Texas a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.
Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Austin, Texas, incluyendo los condados de Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis, y Williamson en el área central de Texas y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.
Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Austin, Texas, incluyendo los condados de Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis, y Williamson en el área central de Texas para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

THE CONSULATE OF MEXICO IN AUSTIN, TEXAS

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Austin Area Office and the Consulate General of Mexico in Austin, Texas (the Consulate), hereinafter referred to collectively as “the Participants;”

RECOGNIZING the joint commitment to protect workers’ rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed Washington, D.C., on September 2, 2021; and

RECOGNIZING that OSHA’s Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Austin, Texas, including the counties of Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis and Williamson in Central Texas, and others information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Austin, Texas, including the counties of Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis and Williamson in Central Texas, regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Austin, Texas, including the counties of Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis and Williamson in Central Texas, to promote understanding of workers’ rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals working in Austin, Texas, including the counties of Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis and Williamson in Central Texas, and their employers.
  • To speak, exhibit, or appear at the Participants’ conferences, local meetings, or other events.
  • To participate in “Mobile Consulate” activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers’ rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in to Austin, Texas, including the counties of Bastrop, Bell, Blanco, Brown, Burnet, Coleman, Comanche, Coryell, Falls, Fayette, Hamilton, Hays, Lampasas, Lee, Limestone, Llano, McLennan, Milam, Mills, San Saba, Travis and Williamson in Central Texas,help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Augusta Area and Bangor District Offices, OSHA 21(d) On-Site Consultation Program – SafetyWorks! (SafetyWorks!) and Maine Brewers’ Guild continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA, SafetyWorks! and Maine Brewers’ Guild hereby renew the Alliance signed April 7, 2021 a continued emphasis to provide the Maine brewing industry and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to safety and health hazards in the craft brewing industry and to understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and SafetyWorks! and Maine Brewers’ Guild recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA’s National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s, SafetyWorks! and the Maine Brewers’ Guild Web sites) to employers and workers in the industry.
  • Provide free safety and health consulting using SafetyWorks! On-Site Consultation Program to assist in addressing site-specific hazards at individual brewery locations.
  • Encourage constituent employers to create site-specific safety and health programs that include OSHA’s Safe & Sound Campaign elements.
  • Speak, exhibit, or appear at OSHA’s, SafetyWorks! and the Maine Brewers’ Guild conferences, local meetings, or other events.
  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on workplace hazards associated with the craft brewing industry including, but not limited to, lockout/tagout, hazard communication, powered industrial trucks, permit required confined spaces, electrical safe work practices, walking/working surfaces, personal protective equipment, and outside contractor safety.
  • Share information among OSHA personnel and industry safety and health professionals regarding the Maine Brewers’ Guild and craft brewing industry and good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Encourage worker participation in workplace safety and health by increasing hazard awareness training and near miss reporting/training.
Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for the craft brewing industry to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
  • Deliver or arrange for the delivery of courses to OSHA compliance and consultation staff pertaining to brewery operations and equipment.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of Augusta Area and/or Bangor District offices and any other appropriate offices. OSHA will encourage State Plans’ and OSHA On-Site Consultation programs’ participation on the team.

This agreement will remain in effect for five years. Any signatory may terminate it for any reason at any time, provided the terminating signatory gives 30 days’ written notice to the others. This agreement may be modified at any time with the written concurrence of all signatories.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Dallas Area Office and Dallas College recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and Dallas College hereby form an Alliance to provide Dallas College students and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to the hazards of all Industries and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This Agreement provides a framework and objectives for the Alliance's activities. Alliance participants (i.e., students and the public) also agree to meet the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to, member surveys to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and Dallas College recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA's National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach) and opportunities to participate in initiatives and the rulemaking process.

  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., print and electronic media, electronic assistance tools, and OSHA and Dallas College websites) to students and the public.

  • Speak, exhibit, or appear at OSHA and Dallas College conferences, local meetings, and events.

  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on all safety topics to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  • Share information among OSHA personnel and industry safety and health professionals regarding Dallas College's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).

  • Encourage worker participation in workplace safety and health by promoting industry health and safety conferences across the region.

  • Develop and disseminate case studies that are issued by OSHA, and other research material published by accredited academic or industry entities and publicize their results.

  • Encourage Dallas College's students and public to build relationships with OSHA's Regional and Area Offices to address health and safety issues, including best practices and compliance.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Baton Rouge Area Office and the Greater Baton Rouge Chapter American Society of Safety Professionals (ASSP), formally named and known as the American Society of Safety Engineers (ASSE), continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and Greater Baton Rouge Chapter ASSP hereby renew the Alliance signed December 19, 2008, with a continued emphasis on providing for those individuals seeking to increase their professional competency in safety and health with information and guidance and access to training resources that will help them protect employees' health and safety.   • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings to help forge innovative solutions in the workplace as well as to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by organizing a forum aimed at worker outreach whereby ideas and information can be exchanged.

The Participants intend to work together to achieve the following training and education goal:

  • To speak, exhibit, or appear at OSHA's or Greater Baton Rouge ASSP conferences local monthly meetings.
  • To work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and the Greater Baton Rouge American Society of Safety Professional's Web site) to employers and employees.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.
