    Alliance Overview

    The Occupational Safety and Health Administration (OSHA) Pittsburgh Area Office and the Ironworker Employers Association of Western Pennsylvania, Inc. (IWEA) aligned to foster and maintain an open line of communication with each other for the meaningful exchange of information on promoting OSHA compliance and Industry best practices in the Construction Industry and to understand the rights of workers and the responsibilities of employers under the Occupational safety and Health Act.

  3. Activities and Products
     

    Evaluation Period.

    March 15, 2011 to March 30, 2012

    Alliance Activity.

    March 3, 2011 – Meeting discussing an alliance renewal agreement using the new verbiage and alliance criteria implemented by OSHA's current administration.

    March 21, 2011 – A technical information meeting on fall protection and the new mobile crane standard requirements relating to proximity to power lines was conducted with a safety representative of a member company as it related to a current steel erection construction job.

    March 30, 2011 – An alliance renewal agreement was signed.

    April 21, 2011 – CAS and a Compliance Safety And Health Officer (CSHO) trainee attended the “Ironworkers Outstanding Apprentice Competition and Annual Contractors/Construction Professionals Open House”.  This event was held in conjunction with and at the Ironworkers Union Local #3 Apprenticeship School. The CAS and trainee received cross training in Ironworker construction activity.  In addition, the CAS provided updated OSHA information and answered numerous questions relating to the construction standards from a variety of construction contractors/professionals throughout the day event. 

    May 3, 2011 – CAS provided Executive Director information on the top twenty-five frequently cited standards in construction and general industry for the past two years in Region III. In addition, fatality statistic handouts were provided for distribution.  The CAS reviewed the resources on OSHA's website on heat stress.

    August 12, 2011 – A pre-construction meeting was held with a safety representative of a member company focusing on installation of shear connectors and wire rope sling use.  

    November 1, 2011 – A pre-construction meeting was held with a safety representative of a member company focusing on safety measures during precast concrete construction.    

    January 12, 2012 – The Executive Director and CAS reviewed submitted packets of construction jobs for upcoming safety awards.  This effort allowed companies and employees that have maintained safety excellence to be recognized.  In addition, this activity enables OSHA to obtain “Best Practice” information on steel erection construction jobsites.

    The Ironworkers Employers' Association of Western Pennsylvania has periodic Safety and Risk Committee meetings throughout the year.  These meetings are used to brainstorm and plan future events; as well as a forum to exchange safety and health technical information and best practices.  In addition, IWEA provides safety educational opportunities throughout the year for members on related industry practices.

    The Ironworkers Employers' Association of Western Pennsylvania is represented on the union joint apprenticeship and journeymen upgrade committee of the Ironworkers Local #3.  The Association appoints contractor members and the Executive Director to the committee.  This committee is responsible for providing skilled construction workers through apprenticeship and training programs.  Safety and Health information is promoted, supported and conveyed through these programs.  The committee also reviews funding, liability, disciplinary and other joint management/labor functions.

    Bill Ligetti, IWEA Executive Director, and member company representatives have called throughout the year for general discussions on OSHA standards/ policy/interpretations and requests for OSHA handouts/publications.

    Alliance Products.

    The IWEA's revised the design of their website this past year.  The website has a safety section, referencing the alliance.  This section also posts various safety and health information (i.e. OSHA news releases, safety bulletins, product recalls, etc.).  The website lists electronic links to various government, labor organizations, and contractor associations.

  4. Results

    The activities and information provided were well received.  The Bill Ligetti, Executive Director, and  member representatives of the safety and health outreach activities/communications found the information valuable in assisting them in promoting and improving their safety and health efforts.  In addition, OSHA representatives found the shared information valuable in expanding their knowledge base on the implementation of good safety practices on steel erection construction jobsites.

    The working relationship between the Alliance Signatories and the feedback on the Alliance continues to be extremely positive. As a result of the positive working relationship, an alliance renewal agreement was signed on March 30, 2011.

  5. Upcoming Milestones

    The Alliance continues to look at future opportunities in providing information for affected parties. The Alliance signatories will continue to work together to address the safety and health needs of the affected parties.

THE CONSTRUCTORS ASSOCIATION OF WESTERN PENNSYLVANIA

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Pittsburgh Area Office and the Constructors Association of Western Pennsylvania (CAWP) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and CAWP hereby renew the Alliance signed December 19, 2005 and last renewed December 15, 2009 with a continued emphasis on reducing and preventing exposure to hazards associated with the heavy and highway construction industry. Specifically, OSHA and CAWP are committed to providing CAWP members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address hazards associated with the heavy and highway construction industry. In renewing this Alliance, OSHA and CAWP recognize that OSHA’s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA’s Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA’s rulemaking and enforcement initiatives:

  • To share information on OSHA’s National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on hazards associated with the heavy and highway construction industry to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by working with member contractors, subcontractors and the heavy and highway joint union apprenticeship committees to promote workplace safety through informational materials, discussions, meetings, organizational events, and training.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop or assist in the development of effective training and education programs for member contractors and others regarding hazards associated with the heavy and highway construction industry and to communicate such information to constituent employers and workers.
  • To develop or assist in the development of effective training and education programs for heavy and highway construction employers and employees to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s and the CAWP Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA’s or CAWP conferences, local meetings, or other applicable events, as resources permit.
  • To share information among OSHA personnel and industry safety and health professionals regarding CAWP good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s rulemaking and enforcement initiatives, training and education, and outreach and communication.  These Alliances have proved to be valuable tools for both OSHA and its Alliance participants.  By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party’s products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants.  In addition, they will meet at least three times per year to track and shareinformation on activities and results in achieving the goals of the Alliance.  OSHA team members will include representatives of the Pittsburgh Area OSHA Office and any other appropriate offices.  OSHA will encourage State Plan States’ and OSHA On-site Consultation Projects’ participation on the team.

THE AMERICAN MUSHROOM INSTITUTE

The Occupational Safety and Health Administration (OSHA) and the American Mushroom Institute hereby renew the Alliance agreement signed on September 28, 2007. This renewal agreement fully incorporates all of the goals of the September 28, 2007 agreement, which are continuing in nature.

OSHA and the American Mushroom Institute continue to recognize the value of collaborative efforts to achieve workplace safety. OSHA and the American Mushroom Institute remain committed to cooperative and proactive efforts to advance workplace safety and health. In renewing this Alliance, OSHA and The American Mushroom Institute recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

In addition, the implementation team will continue to meet on a regular schedule to track and share information on activities and results in achieving the goals of the Alliance. OSHA will afford the opportunity for representatives of the Occupational Safety and Health State Plan Association and the association of state On-site Consultation Projects to participate as well.

This agreement will remain in effect for two years from the date of signing. This agreement may be modified at any time with the concurrence of both signatories and may be terminated for any reason with 30 days written notice from either signatory.

In Addition, this was the Kick-Off meeting for the new Partnership at the PNC Plaza.

    October 25, 2012 - Apprenticeship Information Committee meeting discussing apprenticeship concerns to include future staffing, employment, education, and safety concerns. CAS provided an update.

    November 2, 2012 - Western Pennsylvania Operating Engineers Local #66 - Meeting with Apprenticeship Coordinator discussing clarification of information presented at the past Apprenticeship Information Committee meeting.

    November 8, 2012 - CAS and Business Manager of the Pittsburgh Regional Building and Construction Trades Council meeting discussing finalized addendum for signing for P.J. Dick Partnership Agreement for the construction of the PNC Tower.

    January 28, 2013 - Ironworkers Local #3 - CAS conducted presentation/training at the apprenticeship school as part of an OSHA 30hr Course. Topics covered were worker rights, inspection procedures, multi-employer worksite policy, and General question of a variety of construction standards. In addition, the CAS met with the Apprenticeship Coordinator and instructors discussing member safety and health concerns and OSHA updates.

    February 28, 2013 - Apprentice Information Committee meeting discussing apprenticeship concerns about getting increased diversity in the trades - local community college discussed a free math test prep to improve applicant scores. In addition, upcoming events to promote building trades work and careers in the trades were discussed. CAS presented information on Pittsburgh Area Office fatality stats (with handouts), OSHA focus initiative on falls in construction, government budget issue update, and possibly inviting the acting area director and labor liaison to a meeting (depending on budget concerns).

    March 12, 2013 - CAS attended a contractor educational forum sponsored by the Builders Guild and the Marcellus Shale Coalition. The event took place at the IBEW Local #5 Conference Center/Apprenticeship School. This forum had a variety of speakers and vendors that discussed and provided information on "How to do Business in the natural gas industry". The Business Manager of the Pittsburgh Regional Building and Construction Trades Council was one of the speakers promoting union trades’ involvement in the natural gas industry. The safety requirements and expectations for contractors were discussed. The CAS was able to network with representatives from unions, contractor associations, and the natural gas industry. The CAS provided OSHA updated information to the various representatives and answered a variety of questions regarding OSHA standards and inspection procedures.

    April 29, 2013 - Workers’ Memorial Day - Allegheny County Labor Council, AFL-CIO - CAS and Acting AD attended the Workers' Memorial Day Service held in Market Square, Pittsburgh PA. The Business Manager of the Pittsburgh Regional Building and Construction Trades Council along with representatives from the Trades’ Unions were in attendance.

    May 10, 2013 - Carpenters District Council - CAS attended the Annual Design Build & Carpenter Competition. CAS provided updated OSHA information and answered numerous questions relating to OSHA construction standards/policies/procedures throughout the day event.

    May 16, 2013 - Apprentice Information Committee meeting - CAS presented information and provided handouts on fall protection and heat stress.

    Throughout this evaluation period, the CAS has e-mailed the four safety alerts on product defects relating to, Genie Lift, FallTech/Yoke snap hooks & rebar hooks, RIDGID Nail Gun and Chinese made polyester slings.

    Various Business Agents/Field Representatives and Apprenticeship Coordinators/Instructors call monthly for discussion and guidance on construction standards and OSHA policy/procedure information.

  4. Results

    The training and outreach communication information provided was well received. The member union representatives of the council found the information to be valuable in assisting them in their efforts of promoting and providing safety and health training to their members in reducing and preventing exposure to the various hazards associated with the construction industry.

    Apprenticeship Coordinators, Instructors, Business Agents and members who have called throughout the year indicated the information received from the Pittsburgh Area Office was very helpful in interpreting OSHA’s policies and standards as they related to their current construction activities. The Council represents approximately 21,000 members. The information exchanged with the Building Trades Council would eventually have the potential to affect the entire membership, that being approximately 21,000 members. The working relationship between the Alliance Signatories and the feedback on the Alliance has been extremely positive.

February 2, 2008 – Met with Ironworkers Local #3 Apprenticeship Coordinator to review curricula for upcoming thirty hour training. In addition, the CAS provided the Coordinator with updated information and handouts frequently cited standards, fatality stats, scaffolding publications, employee rights, and “All about OSHA” publications. A variety of questions were answered by CAS on OSHA policies, procedures, and standard interpretations.

May 5, 2008 – CAS met with the Business Representative for the Council to discuss participation in a partnership at a large scale construction site. The partnership development at this future site are in the beginning stages.

May 28, 2008 – A second renewal agreement was signed

The various Business Agents and Apprenticeship coordinators/instructors called several times a month for discussion and guidance on construction standards and OSHA policy/procedure information.

Promoting the National Dialogue on Workplace Safety and Health

The National Office wrote a success story article on this alliance and posted the article on the OSHA public web page. The CAS and various signatory representatives assisted in providing input and developing the article. By posting this article on the OSHA public web page, anyone interested in promoting safety and health in the construction industry can utilize this outreach effort as an example to help assist them in this endeavor.

IV. Results

The outreach efforts and promoting national dialogue through the success story were well received. The Apprenticeship Coordinators, Instructors, and Business Agents found the information and handouts to be valuable in assisting them in their efforts of promoting and providing safety and health training and information to their members in reducing and preventing exposure to the various hazards associated with the construction industry. The Council represents approximately 20,000 members. The information distributed and success story posted on the OSHA public web page affects the entire membership and all parties visiting the success story on the public web page. The working relationship between the Alliance Signatories and the feedback on the Alliance has been extremely positive.

V. Upcoming Milestones

The Alliance is looking into future opportunities in providing information for affected parties through meetings, roundtable discussions and training sessions. The Alliance signatories will continue to work to address the safety and health needs of the affected parties. On 5-28-08 a second renewal agreement was signed (Formalizing the automatic renewal clause required in the agreements by the National Office).

    April 5, 2012 - The Pittsburgh AO CAS met with the CAWP Director of Industry Relations to discuss and provide National Office information on Workers Memorial Day.

    June 22, 2012 - The Pittsburgh AO CAS participated in the CAWP quarterly safety committee meeting.  The CAS presented and provided handout information on heat stress, fall protection, GHS, fatality statistics, and an OSHA update.

    September 6, 2012 - The Director of Industry Relations and member representatives attended a “Fall Protection” training course conducted by the Association of General Contractors (AGC) of America.  This training was the result of a Susan Harwood Grant.  Pittsburgh Area Office CSHOs attended the training.  In addition, the CAS provided instructors with fall protection fact sheets, posters, and stickers.  This event was a venue for the CSHOs and CAS to interact with the CAWP Director of Industry Relations and member representatives.

    September 13, 2012 - At the PA One Call Western Pennsylvania Safety Days, the CAS presented information on excavation safety.  In addition, the CAS and AAD staffed an information booth.  The CAWP Director of Industry Relations and member representatives attended this event.  The CAS and AAD met with the Director and member representatives and discussed issues and concerns on OSHA policies/procedures, work zone safety, and excavation safety.

    September 13, 2012 - The CAS and AAD participated in a youth event promoting the importance of safety in the heavy and highway construction industry.  T this annual event took place at the PA One Call Western Pennsylvania Safety Days. The CAS and AAD were two of the three judges in the Kids Construction Safety Calendar Contest.  Participants were asked to color a picture showing their parent or relative working safely on a heavy and highway construction project.  Before the children began to draw, parents or relatives were encouraged to talk to their children about the importance of safety on a project they had worked on, and the measures that were taken to ensure a safe working environment. Examples may have included discussions on the importance of personal protective equipment, highway work zone safety, trench safety, working around heavy equipment, fall protection, maintaining a drug-free workplace, and general safety awareness. This was a great opportunity to provide a positive outlet for discussion on what construction safety, as well as general safety, means for the entire family.  Many of the participating children had relatives that were members of the Laborers, Operating Engineers and Carpenters.  In addition to the various company members, the Laborers, Operating Engineers, and Carpenters Unions participated as sponsors of the Safety Calendar.

    October 4, 2012 - The CAWP Director of Industry Relations participated in a focus group through a conference call with OSHA’s Directorate of Construction’s Office of Standard and Guidance to assist the agency with addressing the prevention of backover injuries and fatalities.

    October 10, 2012 - The Pittsburgh Area Office e-mailed two safety alerts on a significant near miss involving a fiberglass extension ladder and a defective Miller harness D-ring attachment point to the CAWP Director of Industry Relations.  The Director distributed these alerts to the Safety Committee via e-mail.

    November 6, 2012 - The Pittsburgh Area Office e-mailed a safety alert on a safety deficiency with a Genie Lift to the CAWP Director of Industry Relations. The Director distributed this alert to the Safety Committee via e-mail.

    The Constructors Association of Western Pennsylvania has quarterly Safety and Risk Committee meetings.  These meetings not only work on planning future events, they act as a forum to exchange safety and health technical information and best practices.  In addition, CAWP provides safety educational opportunities throughout the year for both members and non-members in the following areas:  OSHA 10 hour, First Aid/CPR/AED, Mobile Crane Safety, Rigging, Confined Space, Trenching/Excavation, Fall Protection, Flagger Train-the-Trainer, and Accident Prevention for Supervisors, Defensive Driving, and DOT Compliance. 
    The Constructors Association of Western Pennsylvania is represented on all heavy and highway union joint apprenticeship committees operating in western Pennsylvania.  The Association accomplishes this by appointing contractor members to each of these programs, which include the following trade unions:  Carpenters, Cement Masons, Laborers, Operating Engineers, and Pile Drivers.  In addition, a training fund is used for education of Teamsters.  These committees are responsible for providing skilled construction workers through apprenticeship and training programs.  Safety and Health information is promoted, supported and conveyed through these programs.

    Alliance Products.

    CAWP website was utilized to provide safety information and promote the various safety activities the organization conducts.  The website has a link to the on-line safety training provided by the AGC of America.  In addition, the website provided a link to OSHA’s website.

    The Kids Construction Safety Calendar promoting the importance of safety in the heavy and highway construction industry has been a popular product.  In addition, the photos from this calendar were placed on highway billboards throughout the Pittsburgh and Western Pennsylvania areas during Workzone Awareness Week this past April.

  4. Results

    The activities provided during this evaluation period were well received. The member representatives and the recipients of the safety and health outreach activities/communications found the information valuable in assisting them in promoting and improving their safety and health efforts at their heavy and highway construction jobsites.

    The individuals reached by the outreach activities/communication activities represent companies/unions with many employees/members that would be directly affected by the safety and health information provided.  The working relationship between the Alliance Signatories and the feedback on the Alliance continues to be very positive.

  5. Upcoming Milestones

    As a result of the positive working relationship between the Alliance signatories, an Alliance Renewal Agreement was signed on December 20, 2011. The Alliance is continually looking into future opportunities in providing information for affected parties through internet use, roundtable discussions and training sessions.  The Alliance signatories will continue to work to address the safety and health needs of the affected parties.

    Alliance Overview:

    The statewide Pennsylvania Chamber of Business and Industry (Pa Chamber) is the largest broad-based business association in Pennsylvania and the second largest state Chamber in the United States. The Pa Chamber has over 10,000 customers; 82% being considered small employers with less than 100 employees and 1/3 of their members having less than 10 employees. By combining OSHA’s safety expertise with the broad base of employers who belong to the Pa Chamber, OSHA’s resources can be leveraged more effectively. Our common goal is to help employers through outreach, training and educational safety programs that they can take back to and implement at their individual work places.

    The Alliance between OSHA and the Pa Chamber provides a platform to reach small employers and provide necessary information, guidance, and access to training on a variety of safety regulations and best practices from the OSHA website. These are all resources that companies may not experience without these OSHA educational sessions which are organized and facilitated by the Pa Chamber.

  2. Implementation Team Meetings

    From March 5, 2013 till March 5, 2014: Numerous contacts (telephone conference calls and mail exchanges) were made to plan and prepare for each of the sessions. The actual planning for the 2013 events started prior to the evaluation period, so if pertinent, these earlier dates have also been included. The more notable contacts included:

    1. 2012 Oct 30: We matched presenter up with the possible topics for the 2013 conference. The Pa Chamber was to then follow up with the presenters to determine their availability.
    2. 2012 Nov 6: The Pa Chamber contacted the Area Directors and speakers to determine their availability and willingness to present.
    3. 2012 Nov 13: The Pa Chamber sent the draft agenda for review for the March 2013 round table.
    4. 2013 Jan 14: Planning call for the 2013: During the call we reviewed the details for the three half day round tables this year in March. We then continued to discuss the full day round table scheduled for, May 16, 2013 and discussed hot OSHA topics: OSHA will give the introductory presentation to address heat stress, the new Hazard Communication Standard-2012, regulatory agenda and the top 10 cited hazards. Steve High will be ask to present walking and working surfaces/fall protection. Other topics for the round table: Distracted Driving and Injury and Illness Prevention Program (I2P2).
    5. Half Day Roundtable sessions were held throughout the Commonwealth: March 7, 2013 in Camp Hill, March 15, 2013 in Pittsburgh and March 27, 2013 in Valley Forge.
    6. 2013 Mar 20: We discussed creating a dedicated OSHA corner on the Pa Chambers monthly email distribution.
    7. 2013 May 16: The Full Day Roundtable was conducted.
    8. 2013 May 20: Began planning topics for the 2014 full day conference.
  3. Activities and Products

    Evaluation Period.

    Alliance Activity.

    • Training and Education:
    1. Spring Half Day, Ask OSHA Roundtables were held throughout the Commonwealth in March 2013. The first session was held in Camp Hill (Harrisburg area), Pa on March 7, 2013, followed by Pittsburgh on March 15, 2013 and ending in Valley Forge on March 27, 2013. Each session opened with information from the Pennsylvania Chamber followed by an OSHA updated from each of the OSHA Area Directors from each of their perspective jurisdictional areas. The CAS from the Harrisburg Area Office provided a boilerplate presentation to be used as a guide for the other area offices to assist in presentation uniformity.
      • The OSHA Update reviewed means for people to enter the OSHA staff utilizing Pathways, a review of the leadership in Region III, changes occurring at the National Office lever within the Directorate of Enforcement Programs (DEP), the current emphasis programs and ending with what is new in OSHA: fall hazards in construction, heat stress campaign, Hispanic outreach, deadlines for the Hazard Communication Standard (HCS) new standard requirements, distracted driving, workplace violence and whistleblower protection.
      • Chuck Baker, Certified Safety Professional (CSP) with Inservco Insurance Services, Inc. presented, "complying with OSHA’s Respiratory Protection Standard". Mr. Baker reviewed the elements of a compliant respiratory protection program, respiratory selection process, fit testing procedures, how to maintain a respirator, service life for cartridges and filters, what is needed to comply with the medical evaluation requirement, details for respiratory training and how to evaluate your respiratory protection program.
      • Steve Lane and Steve Pakosh, Health and Safety Training Specialists from the Bureau of Worker’s Compensation Health & Safety Division for the state of Pennsylvania presented on "Hazard Communication Regulations, the New Deadlines and Compliance with the Globally Harmonized System". During the presentations they described the key elements of the standard, need for new Safety Data Sheet (SDS), changes to labeling, why it is important to update the written program and training portions of the program to agree with the changed standard. What to do in an accident, deadlines for compliance and tips to manage these changes.
      • There were 180 people in attendance at the three locations. 87 in Harrisburg, 48 in Pittsburgh and 45 in Valley Forge.
    2. On May 16, 2013 the Pa Chamber held the Annual Workplace Safety Conference in Harrisburg, Pa.
      • OSHA provided an OSHA update including a review of: the whistleblower protection program, need to protect the temporary workers, the Fall 2012 unified agenda, heat stress campaign, revisions to the Hazard Communication Standard (HCS), review of the types of citations issued by OSHA, help available through OSHA Consultation and wrapping up the session with information about our OSHA Training Institute (OTI) Educational Centers.
      • Following the OSHA Update, David Campbell, Certified Safety Professional (CSP) for PPL Corporation reviewed, "Strategies to Manage Your Injury and Illness Prevention Programs". This session reviewed American National Standard Institutes (ANSI) Z-10.1, OSHA Voluntary Protection Program (VPP) 1989 guidelines and Health and Safety Advisory Services (OHSAS) 18001 Health and Safety Management System requirements to prepare attendees for the yet to be published Injury and Illness Prevention Program (I2P2).
      • Mr. Steven High presented, "Complying with Walking Working Surface Standards, including Slips, Trips and Falls". Although this presentation addressed slips, trips and falls, half the presentation was directed at fall related injuries from ladders, hole openings, wall openings, stairs, and scaffolding. With the reminder of the time dedicated to slipping hazards.
      • 73 people attended the event.
    3. OSHA also participates in Pennsylvania’s "Recertification Training for Workers’’ Compensation Safety Committees". The sessions are conducted by the Commonwealths Health & Safety Division out of the Department of Labor and Industry. Sessions are required by the Commonwealth for companies to maintain their certified safety committees. Attendees are comprised of equal numbers of managers and employees from companies from throughout the state. The Pa Chamber hosts these events in three locations in Pennsylvania, only one is in Harrisburg’s jurisdictional area. Each year the CAS speaks to the Harrisburg group about safety systems, about the 1989 Voluntary Protection Program (VPP) guidelines and the proposed Injury and Illness Prevention Programs (I2P2). OSHA also staffs a booth to provide publication resources and answer the public’s questions. 57 people attended the September 26, 2013 session.
    • Outreach and Communication

      Each week the Pa Chamber sends 5,000 of its members a generic newsletter referred to as a News Byte, frequently these include a safety item. In addition, the Chamber publishes an electronic quarterly Safety/OSHA Bulletin that is sent to Chamber’s members who are Safety and Environmental Directors; this newsletter is devoted entirely to safety issues. Information for the News Bytes and Safety/OSHA Bulletin come from information received from the local OSHA office directly or from "OSHA QuickTakes", OSHA's Newsletter. Things sent this last year include: OSHA Bulletin: Heat Stress Prevention, Fall Prevention, and OSHA Bulletin: Hazard Communication Changes.

      The Commonwealth also provides materials to the Chamber, such as Pennsylvania Training for Health & Safety (PATHS) and opportunities to apply for the Governor’s Award for Safety and Health. This information is shared with the Chamber members.

    • Promoting the National Dialogue on Safety and Health

      During each of the OSHA Roundtables the CAS reviews current OSHA initiatives including the National Emphasis Programs, Local Emphasis programs, a review of the Regulatory and Unified Agendas, OSHA’s top ten cited hazards in addition to campaigns, including: heat stress, fall protection and any other trending issues for Pennsylvania businesses.

      These efforts continue with the local Harrisburg Area Office (HAO) sending current information to the Pa Chamber, who is listed on Harrisburg’s stakeholder list. The CAS provides all stakeholders current, pertinent information as it relates to workplace safety hazards. From here the Chamber shares the information with their stakeholders.

      Alliance Products

      The products produced during the reporting period were, increased safety awareness for business through the multiple safety roundtables orchestrated by the Pa Chamber and conducted throughout the Commonwealth, emailed Safety/OSHA Bulletins generated by the Harrisburg OSHA Office, emailed News Bytes that are received from OSHA and an open communication between attendees and OSHA. The Harrisburg Area Office created information for the Pa Chamber to share on the following topics: OSHA Bulletin: Heat Stress Prevention, Fall Prevention, and OSHA Bulletin: Hazard Communication Changes.

  4. Results

    A. The ninth year of the Alliance was devoted to presenting information to the Chambers at two scheduled "Ask OSHA Roundtable" sessions. Similar activities are planned for the coming year. During the last year the Chamber offered two additional sessions one in the Philadelphia area and the other in the Pittsburgh area. We also created OSHA Bulletins that were shared throughout the Commonwealth.

NOTE: The table below does not include the various meetings held over the last year or the numerous participants that benefited from the varied safety and health discussions at each of these meetings.

  5. Upcoming Milestones

    We have planned similar events for 2014. The Pa Chamber will begin the half day Ask OSHA Roundtables in Harrisburg on March 7, 2014, followed by Pittsburgh on March 13, 2014 and ending in Philadelphia on March 20, 2014. The full day Workplace Safety Conference will be held in Harrisburg on May 28, 2014. OSHA will have a part in all the events and answer safety related questions from the audience at each. To increase OSHA employee involvement, OSHA will participate at the Pa Chambers, Recertification Training for Workers’ Compensation Safety Committees on September 18, 2014 in Harrisburg. All parties involved with the alliance are interested in renewing the alliance in 2014.

La Oficina regional en Filadelfia de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Filadelfia, Pensilvania (el Consulado), en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 6 de noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en los estados de Pensilvania y Delaware, información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en los estados de Pensilvania y Delaware sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en los estados de Pensilvania y Delaware a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en los estados de Pensilvania y Delaware y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en los estados de Pensilvania y Delaware para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

The Occupational Safety and Health Administration (OSHA) and the Pennsylvania Chamber of Business and Industry (PCBI), hereby renew the Alliance agreement signed on March 29, 2004. OSHA and PCBI continue to recognize the value of collaborative efforts to achieve workplace safety. OSHA and PCBI remain committed to cooperative and proactive efforts to advance workplace safety and health. In renewing this Alliance, OSHA and PCBI recognize that OSHA’s Consultation Project partners are an integral part of the OSHA national effort.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

In addition, the implementation team will continue to meet on a regular schedule to track and share information on activities and results in achieving the goals of the Alliance. OSHA will afford the opportunity for representatives of the state Consultation Projects to participate as well.

This agreement will remain in effect for two years from the date of signing and will automatically be renewed annually thereafter. This agreement may be modified at any time with the concurrence of both signatories and may be terminated for any reason with 30 days written notice from either signatory.

    August 4, 2010 - The Pittsburgh Area OSHA Office, P.J. Dick-Barton Malow, a Joint Venture and the Building Trades Council signed a Partnership agreement for the construction of the UPMC East Hospital construction project.

    August 18, 2010 - CAS had a meeting with the Steamfitters Local #449 Apprenticeship Coordinator and instructor to discuss safety and health curricula, concerns and needs. Information/training was provided on the new expansion of the Introduction to OSHA for 10 and 30 Hour courses. CAS provided updated handouts on frequently cited standards and fatality statistics out of the Pittsburgh AO. A variety of questions were answered on OSHA policies/procedures and interpretations.

    August 27, 2010 – As a result of the cross-training venue in the Alliance four OSHA representatives (CAS and CSHOs) from the Pittsburgh Area Office received training at the IBEW apprenticeship school on electrical work/safety.

    October 7, 2010 – A meeting was held at the Greater Pennsylvania Council of Carpenters Apprenticeship School with the CAS, and representatives from the Carpenters, Pile Drivers, Operating Engineers, Master Builders Association, and the Constructors Association of Western Pennsylvania. This was an information meeting to discuss provisions in the new crane standard.

    October 15, 2010 – CAS had an information meeting with the Ironworkers Local #3 Apprenticeship coordinator and instructors on provisions in the new crane standard.

    November 3, 2010 - As a result of the cross-training venue in the Alliance three OSHA representatives (CAS and CSHOs) from the Pittsburgh Area Office received training at the Ironworkers apprenticeship school on steel erection. The Ironworkers apprentices and Operating Engineers apprentices conducted hands on training by disassembling and reassembling a two story structural steel mock building. In addition, the CAS presented OSHA policy/procedure information to include the complaint process and worker rights.

    November 10, 2010 – The CAS and AAD-Safety, met with the Ironworkers Local #3 Apprenticeship Coordinator and a Safety Director from a member company of the Ironworkers Employers Association (IWEA) to discuss provisions of the new crane standard.

    January 14, 2011 – As part of an OSHA 30 Hour course for the Ironworker Local #3 apprentices, the CAS passed out handouts and presented information on worker rights. In addition, the CAS answered a variety of questions on OSHA policies/procedures and standards.

    April 7, 2011 - CAS met with Western Pennsylvania Operating Engineers Apprenticeship Coordinator, Crane Instructor, Business Agent, and Special Pipeline Representative. Various safety and health concerns were discussed relating to OSHA construction standards and policies.

    April 12, 2011 - CAS staffed an information booth on Career Day at the Forbes Road Career and Technology Center (Event sponsored by CAWP). The primary purpose of the event was to raise the awareness of high school students to the career paths available to them. The focus of the event was to promote careers related to highway and bridge design, construction, maintenance and construction safety. The apprenticeship coordinators and instructors from the following Pittsburgh Building Trades Unions participated in the event: Laborers Local #1058, Ironworkers Local #3, Operating Engineers Local #66, Cement Masons Local #526, Bricklayers/Allied Craftworkers Local #9 and Carpenters District Council. The CAS visited the various hands-on demonstrations by the Unions to promote OSHA and safety relating to highway and bridge construction and maintenance work.

    April 21, 2011 - The CAS attended the Ironworkers Local #3 Outstanding Apprenticeship Competition and Annual Contractors/Construction Professionals Open House event. The CAS provided updated OSHA information and answered numerous questions relating to OSHA construction standards throughout the event day. Various Business Agents and Apprenticeship coordinators/instructors call monthly for discussion and guidance on construction standards and OSHA policy/procedure information.

  4. Results

    The training and outreach communication information provided was well received. The member union representatives of the council found the information to be valuable in assisting them in their efforts of promoting and providing safety and health training to their members in reducing and preventing exposure to the various hazards associated with the construction industry. In addition, the OSHA staff that received cross-training from the IBEW and Ironworkers found the training to be excellent and extremely valuable in assisting them in the field. Apprenticeship Coordinators, Instructors, Business Agents and members who have called throughout the year indicated the information received from the Pittsburgh Area Office was very helpful in interpreting OSHA’s policies and standards as they related to their current construction activities. The Council represents approximately 20,000 members. The information exchanged with the Building Trades Council would eventually have the potential to affect the entire membership, that being approximately 20,000 members. The working relationship between the Alliance Signatories and the feedback on the Alliance has been extremely positive.

  5. Upcoming Milestones

    As a result of the positive working relationship between the Alliance signatories, an Alliance Renewal Agreement was signed on May 27, 2010. The Alliance is continually looking into future opportunities in providing information for affected parties. The Alliance signatories will continue to work to address the safety and health needs of the affected parties.
