OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of being struck-by: a/ Inside of the Painting Department, employee(s) were exposed to a struck-by hazard due to a possible unplanned collapse of two metal, shelving units, each three tiers high, that were not anchored. One method of abatement to correct this apparent hazard is to bolt or otherwise secure both shelving units to the concrete floor as required by ANSI MH16.1-2012, paragraph 1.4.7.
