Text For Citation: 01 Item/Group: 013A Hazard:
29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposes an employee to injury and the defective or damaged item was not removed from service: a) Icing Area- The employer failed to ensure that equipment, such as the Econo Icers, were removed from service if they became defective or damaged until repairs and tests necessary to render the equipment safe to use were made. The Econo Icers were being used with defects and damage to their plugs and the plug receptacles that they were plugged into. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
