29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): Location: Loading dock On or about 5/20/14, the employer allowed operators to continue operating powered industrial trucks with a non-functional horn, head lamps out, a damaged tire, and corrosive lead/acid leaking out at the top of the battery, rendering the following but not limited to powered industrial trucks unsafe; 1. Yale, model #ERC0J0RGN36TE082 - no horn and one light out. 2. Yale internal id#25486 - corrosive lead/acid leaked out at the top of the battery. 3. Yale internal id#35937 - a damaged rear tire. 4. Yale internal id#35772 - lights did not work. 5. Yale internal id#25406 - one light out.
