OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards which are causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion and deflagration hazards caused by a dust collector deflagration: a) This violation occurred on or about April 26, 2014, at the sander dust collector where employees responding to a fire were exposed to explosion and burn hazards when the dust collector bags impeded the venting area of the dust collector deflagration vents. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that dust collector bags do not impede the dust collector venting area. b) This violation occurred on or about April 26, 2014, at the sander dust collector where employees responding to a fire were exposed to deflagration and burn hazards from the explosion vents releasing in the dust collector without taking measure to protect employees from the fireball path. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that measures are taken to protect employees from fireball paths. c) This violation occurred on or about April 26, 2014, in the finishing department where employees responding to a fire at the sander were exposed to burn hazards when the dust collector vented and the deflagration traveled upstream to the sander. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that an isolation device is installed to prevent a deflagration from traveling upstream. d) This violation occurred on or about April 26, 2014, on the north side of the facility where employees were exposed to explosion and deflagration hazards when responding to a fire within the sander dust collection system without the main blower remaining in operation. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that the dust collection system remains in operation when processing wood stock. e) This violation occurred on or about April 26, 2014, at the sander dust collector where employees were exposed to explosion and deflagration hazards when responding to a fire within the sander dust collection system without a choke between the sander dust collector and silo leading to the briquetter. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that the dust collector discharge arrangement contains a choke to prevent propagation between the collecting equipment and storage facilities.
