29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l): (a)Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013, the employer did ensure that each employee who operated the forklift at the facility was provided with operator training as required under the standard. This condition exposed employees to the hazard of unsafe operation to serious injury or death from lack of appropriate forklift training. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. All operator training and evaluations shall be certified and conducted by a person who has knowledge, training and experience to train and evaluate the operator's competence in the workplace.
