Text For Citation: 01 Item/Group: 001B Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to struck-by hazards while operating a rough terrain fork truck at night where the fork-truck did not have lights: a) On or about March 29, 2007, the employer did not ensure that employees were protected from injuries while operating a rough terrain fork truck at night without lights. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to comply with ANSI B56.6-2005, section 5.8.2, by installing lights on the vehicle.
