North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: [Ref: American National Standard (ANSI Z245.5-1997) para. 7.1 (c)] a)facility, baling room - employees operating a Galaxy 2R Two-Ram Baler serial number 165213, model 2R-150-57-N-F and the employer did not provide a program of training and instruction in the safe methods of work before assigning them to operate or maintain the baler. b)facility, baling room - The employer did not maintain records of this training to include the date (s) of the training and the content of training conducted. c)facility, baling room - The employer did not ensure by adequate supervision, that correct operating and maintenance procedures were understood and followed. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a Spanish translator, as all the employees did not speak, understand, or write English, to assist with the training of non English speaking employees.
