Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the jobsite an employee was allowed to conduct work operations using a John Deere, model 310C, serial number T0310CA772891, without the boom swing lock pin available for use as required by the manufactures operating manual. The employee was exposed to the type of hazards associated with fatal injuries due to being caught in between the boom and the rear of the vehicle. Among others, one feasible and acceptable method of abatement would be to obtain the manufacture's operator manual and the boom swing lock pin and require their use as outlined in the manual.
