Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a tree during felling processes. a)On or about 11/12/02, at 8668 Chattsworth Hwy., employee was cutting a tree and was exposed to being struck by a tree due to not properly assessing an escape route before cutting the tree. Among other methods, one feasible and acceptable method to correct the hazard would be to plan an escape route before cutting any tree or trunk as stipulated in ANSI Z133.1-2000, section 9.5.13. b)On or about 11/12/02, at 8668 Chattsworth Hwy., employee was cutting a tree and was exposed to being struck by a tree due to not cutting notches with a 45 degree angle. Among other methods, one feasible and acceptable method to correct the hazard is to cut notches 45 degrees or greater as stipulated in ANSI Z133.1-2000, section 9.5.15.2. ABATEMENT VERIFICATION REQUIRED AT TIME OF ABATEMENT
