Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A finger amputation hazard due to the fact that the used a portable circular saw as a stationary saw, with jury rigged accessories, on or about 5/15/01. a)On site at 1 River Place. One feasible means of abatement would be to use the portable circular only as a portable circular saw as intended by the manufacturer, and only use manufacturer recommended accessories, as stated in the owners manual for the DeWalt DW364 page 10. NOTE: Because of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
