29 CFR 1904.39(a)(1): Basic Requirement. Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor. On or about October 29, 2021, the employer was notified by the daughter of the deceased of the passing of a maintenance/driver employee as a result of COVID-19. The employer did not notify or report to OSHA the fatality within eight hours after the death of the employee.
