29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Dunaway Excavating, Inc. at 4387 Lacewood Lane, Johnstown, CO 80534: On April 16, 2021, and at times prior, the employer did not ensure that adequate precautions had been taken to protect employees who were tasked to enter excavations that had accumulated and were accumulating water. On April 16, 2021, employees were working in an excavation which was approximately 19 feet wide at the top, 11 feet wide at the bottom, and 16 feet deep in type B soil that accumulated approximately two feet of water at the bottom of the excavation, in order to install a sewer tie-in. The trench did not have a trench box or shoring, or adequate sloping or benching, and no system to remove the water from the excavation. This condition exposed employees to a cave-in and struck-by hazards.
