29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Jose Oliverio Larios Morales, at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074 : On and/or preceding January 2, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was installing ice guard underlayment to the roof of a new construction three story roof without fall protection. The employee fell 30 feet from the roof, resulting in the death of the employee.
