Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards. (a) On or about June 26, 2020, two employees were rigging a steel tank weighing 7,375 pounds to be lifted by a 20 ton capacity bridge crane with hoist and chain sling. The steel tank was on the ground and had lifting points on all four corners, and during the rigging process the wireless radio controlled pendant transmitter, that controls motion of the crane was unintentionally operated before the steel tank was properly rigged, causing the steel tank to move and crush the victims legs between the steel tank being rigged and another steel tank adjacent to it. The radio controlled wireless pendant was not placed in a safe location while rigging was being done, exposing the employees to a crushing hazard.
