29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not protect each employee from a fall hazard while utilizing ladders to access the roof of a residential home which is 10.4 feet above the ground by ensuring that the ladder is extended 3 feet above the roof line or secured and with a grasping device provided. a) This most recently occurred on June 18, 2020 at 8774 Mottl Reserve Drive, Sagamore Hills, OH 44067. Employees are exposed to the hazard of falling approximately 10.4 feet to the ground below when utilizing a portable ladder to access the roof. The ladder is not extended 3 feet above the roofline and is not secured with a grasping device provided. RAM ROOFING, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1) which was contained in OSHA inspection number 1433494, citation number 1, item number 3, and was affirmed as a final order on December 26, 2019, with respect to a workplace located at 10 and 11 Yesterday Lane and Lafayette Road, Medina, OH 44256. To abate the hazard in the future, the employer must ensure that its employees are protected from injury during ladder use by ensuring use that ladders utilized for roof access are extended 3 feet above the roof line or alternatively, secured to the roof while also incorporating a grasping device. Pursuant to 29 CFR 1903.19 the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from hazards during ladder use.
