OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees: a) Work site was located at 4711 Dell Avenue, North Bergen, NJ 07047 The employer does not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that it is the employer's practice to expose employees to the hazard of being caught between a retaining wall and moving railroad cars and/or being struck by moving railroad cars or payloaders during brake riding operations. Violation occurred on or about January 2, 2020. Lincoln Recycling Services, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number1320236, citation number 1, item number 1B and was affirmed as a final order on August 6, 2019, with respect to a workplace located at 4711 Dell Avenue, North Bergen, NJ 07047.
